A con man may be smart enough to escape death row by pretending he’s mentally retarded. Are we dumb enough to buy it?

Apelt arrived in the United States from his native Germany in 1988. He was 25. In four short months, he flim-flammed more people than many con men do in a lifetime.

He never studied English in school, yet expressed himself well enough to get a half-dozen Americans to loan him big bucks. He had no income, yet he charmed Jaguar dealers into letting him take their expensive toys out for a spin.

And even though he was traveling with an ex-girlfriend, he managed to persuade a lovely, bright 30-year-old Mesa woman to elope with him in Vegas, then take out $400,000 in insurance policies on her life. Then he brutally murdered her.

Pretty sick stuff. But not, in any way, the behavior of a mentally retarded person.

That's why it's so unbelievable to me that Apelt, sent to death row in 1990, will return to a Florence courtroom next week for what could be his biggest scam yet.

He really is claiming that he's mentally retarded.

Yep, and our judicial system really is giving him a two-week hearing, with all the trimmings, to prove it. We, the taxpayers, are financing his talented lawyer, his expensive psychiatric experts, the judge who will give him every last benefit of the doubt, and, of course, the assistant attorney general charged with fighting them.

The stakes are real: If he can convince the judge he's retarded, Michael Apelt doesn't only escape execution. He could also get out of jail in just seven years.

Every last shred of evidence says that Apelt is faking it, just as he faked loving his bride even as he put in motion the plan to kill her.

But these days, as a nation, we're so conflicted about the death penalty that we'd rather bend over backwards for a known con man and his latest ridiculous claim than use common sense.

I love this country. Yeah, that's a little sarcastic, but really — aren't we nice?


I first heard about Michael Apelt from Kathy Monkman. I wasn't living in Arizona when Apelt was last in the courtroom, when local TV reporters breathlessly covered his murder trial.

But when I moved to Phoenix two years ago, I wrote my first New Times cover story about Kathy. (The tale is way too complicated to get into here, but you can read it online.) At the time, we talked only briefly about Kathy's beloved older sister, Cindy, who had been Michael Apelt's second wife — and his murder victim.

Since then, Kathy and I have become friends, and we've talked about the case quite a bit more. In the past few weeks, I've read the court files in Pinal County. I also read Apelt's file at the Arizona Department of Corrections, and files from the case in which he attempted to divorce his fourth wife. (Yes, this "retarded" man has managed to persuade four women to marry him.)

I've also read the files on Rudi Apelt, Michael's brother, accomplice, and fellow death row inmate. Rudi also will try to prove his retardation at next week's hearing, but that case isn't quite as clear: Was Rudi a dimwit who followed his brother? Or a fellow con man? It could go either way.

But with Michael, there's no question. All three sets of documents are amazing testaments to his mental abilities. Clearly, this is a guy who knows how to work all kinds of systems.

That comes as no surprise to Kathy. She vividly remembers her suspicion of her older sister's whirlwind romance. Right away, she says, she thought Michael Apelt was a "slick, lounge lizard, manipulating type of guy."

Kathy, however, never imagined that Apelt would kill Cindy — or surface in the court system 17 years later claiming to be retarded.

She remembers visiting the newlyweds and Michael explaining what a difficult time he'd had making his mother's signature German potato salad. He said that he'd had to travel to several different grocery stores to find capers. "He just thought it was ridiculous that Americans didn't know about capers," Kathy tells me, shaking her head.

How many people with mental retardation could give you that kind of monologue — in a foreign language, no less?

Now, you don't have to be a death penalty activist to believe that people with severe mental impairment are better served by life behind bars than execution. For someone who doesn't know enough to function in society, a life sentence without possibility of parole is punishment enough.

But there are two problems when it comes to Michael Apelt.

One: Life without parole wasn't an option at the time of Apelt's crime. If his death sentence is reversed, Michael Apelt could apply for parole in just seven years. He could literally walk free.

Two: Michael Apelt isn't retarded.

When Apelt was 8 years old, he took an IQ test and scored an 88, which doesn't make him Einstein but does put him in the normal range. Only after the U.S. Supreme Court ruled in 2002 that it was unconstitutional to execute people with mental retardation did Michael Apelt score a 65.

There's no doubt in my mind: A man smart enough to set up an insurance scam is a man smart enough to fail a test.

    Why are these animals still breathing? They had the right to a prompt and fair trialin a court of law. We have the right to see the sentence carried out equally promptly. The current situation is a farce. The judge should be recused, recalled and forced to applogize to the victim's family publicly. If they committed the crime,they should pay the penalty, it doesn't make any difference if they are Einsteins or dumber than a turnip, they have forfeited the right to breathe our air.

    Why are we even housing people from other countries? This is why our country is becoming so overcrowded. Where are our children going to live in a few years, because of people sneeking into our country starting prositution rings, committing fraud, murder, and us having to pay for it all? Heck yes, we are too nice of a country. He does look like he could be retarded but this could be from all the craziness in this world, of women doing drugs when they are pregnat, or drinking, or from sleeping with their own cousins, this is what their children look like. Then we wonder why there are so many mental people in our country. We need to wake up and smell the coffee because our tax dollars are definetely not being used wisely. Anyone who lets these fools get away with what they have committed is just as "retarted". AND WATCH THEY WILL GET AWAY WITH IT! THEY WILL STILL ROAM OUR STREETS WHEN THEY GET OUT.

    Thank you Sarah for such a hard hitting and precise column about what my family is being faced with right now. The hearing is going to proceed, as I understand, Monday morning as planned. However, there is currently, as of Friday of this week (3 days before the hearing is to begin) a special action pending to get Judge Arellano recused from this case. This, in my opinion, is an entirely appropriate action by the State. She remains the one and only finder of fact in this case, yet has demonstrated by her rulings and unethical behavior, her obvious bias toward the defense and the murderers in this case. This escalated to a point where, this past week, she recused Cathy Hughes who you mention in the column here, who came out of retirement to try and assist the AG's office for no compensation, but guided by her conscience. One of many problems in Judge Arellano recusing her (which came as no surprise to any of us per all her bizarre rulings on this case) is that she did so breaking major ethics violations for a Judge. She met with the defense team in an ex parte meeting to determine her decision and disallowed the State any oral argument. Then she ruled to dismiss Cathy. There was a meeting with a Supreme Court Justice yesterday to overturn this ruling and to my knowledge the outcome is still somewhat up in the air. So we begin this hearing on Monday, not knowing for sure who the Judge will be who hears it and who will be seated at the prosecutor's table. A hearing that has been being prepared for for over 3 years. If anyone out there reading this is a praying person, please keep your focus on JUSTICE in this case and that murderers do not get to become victims and that Judges don't get to play out political agendas in the courtroom. Justice is still hiding in the middle of all this and please help me and my family evoke it. Remembering the ONLY victim in this horrific event was my sister, Cindy.

    I think that the Apelt's claim of mental retardation, and indeed any convict claiming retardation as an excuse for leniency in sentencing is a despicable insult against the truly retarded. As a group they should be insulted that they are thought to be so mentally disabled that they cannot understand that it is wrong to BEAT, STAB and MURDER people. I am insulted for them! In essence that is saying they are so retarded we should mistrust them... even FEAR them because they don't understand not to be violent. I disagree with that. The associations such as ARC and others should think twice then think again before further supporting the cause of such vile murderers and embracing them as one of their own.

    I don't know what else I can add to the astute comments before mine,especially the article itself, but I will say, this. Is. Pure-T-BULLSH*T. I'm no genius, but I'm not retarded either and I know I could not have pulled off half the crap these two did leading up to the murder of Cindy and the attempted cover up afterward. It appears to me that they were both born con men, turned MURDERERS and DO NOT deserve anything more than what they left poor Cindy with! Oh what's that? Nothing? That's right, those Bastards deserve n o t h i n g. The consequences they received when they were convicted should be upheld, beyond a reasonable doubt.

These two monsters need to pay for what they did to Cindy Monkman. They don't deserve to be heard because they are not mentally retarded. They are sick, vicious human beings.

    A judge is supposed to uphold the law, NOT change the law. Judge Arrellano's obvious bias against the death penalty and pro defense in this case is appalling. Not only should she be recused in this case, she should be RECALLED for not upholding her oath of office as a judge. That oath states: State of Arizona, County of ______________ I, _____________________ (type or print name) do solemnly swear (or affirm) that I will support the Constitution of the United States and the Constitution and laws of the State of Arizona, that I will bear true faith and allegiance to the same and defend them against all enemies, foreign and domestic, and that I will faithfully and impartially discharge the duties of the office of ______________________ (name of office) ________________________ according to the best of my ability, so help me God (or so I do affirm). She has NOT supported the laws of the State of Arizona, and she has NOT IMPARTIALLY DISCHARGED the duties of her office. Get rid of her now! If this case is not enough to generate a recall effort, I don't know what is.

Germany has the support of Amnesty International, both of which unequivocably oppose the death penalty as punishment for any crime. In all cases! Yet the Arizona and US court system is being bullied into accepting that unilateral stance by some clever defense lawyers (paid for with US tax dollars). That is not the US law and if German nationals don't want to get sentenced to death they should not come here and commit such henious and unforgivable crimes.

    Sarah, what an excellent article. Thank you for again bringing Cynthia Monkman's murder and the unconscionable way that her killers are being held up as imbiciles and therefore not responsible for killing her. I think Germany is still mad about the Legrand brothers and are embarrassed that another pair of brothers from the homeland have snuffed out yet another bright and beautiful life. There is no evidence that the brothers Apelt are anything less than manipulative, conniving, homicidal maniacs. But retarded? I think not! Recently in Florida, John Couey was found responsible for the murder of Jessica Lunsford. He is a slobbering fool who can't even write and was found not to be retarded. Should the Apelts have some other, more lenient standard applied? Another thing that should be considered in examining the Apelt IQ -- the Flynn effect. In other words, if Michael Apelt was found to have an IQ of 88 when he was eight years old, using today's "re-normalized" tests his IQ number could very well sink significantly (yes, we are getting "smarter" but it's hardly apparent in the Arizona courts this week!). But a number only tells a tiny fraction of the whole story. A retarded person has serious limitations on the ability to appreciate the consequences and gravity of one's actions and to exercise mature control over one's conduct -- that's a far cry from the methodical and devious means with which the brothers Apelt snared and eliminated their prey (using Jaguar automobiles, tuxedos, expensive jewelry, and plenty of English to seduce a beautiful young woman). If these monsters get leniency it will be a huge travesty of justice and I commend you for your unrelenting efforts to expose the truth and justice of this case.

    I believe this judge, Silvia Arellano, has strong feelings on the death penalty and is making this case a personal platform. This is wrong. A judge's purpose is to preside over court proceedings according to the law as it stands at the time of trial. They should not allow their personal feelings, prejudices and causes to color their decisions. Is that what is happening in this case? I think so. I believe Judge Arellano wants to be able to pat herself on the back and consider herself the personal saviour of two men who murdered an innocent human being. Would she feel good about herself, would she feel proud of herself if within a few short years the Apelts, two brutal murderers, walked out free? In my opinion, yes she would. This is despicable. Despicable Thank you for a good, solid, hardhitting article, Ms. Fenske. I sincerely hope that you and others attend this proceeding when it takes place. I want the world to read a report of how the family of the victim is treated within the confines of the courtroom. My guess is they will be flayed by the crass insensitivity and disregard of the attorneys for the murderers.

I think not. I do find the argument, however, to be moronic.

    What a kick in the teeth this has to be to the victim's family, the Monkmans, as we wrap up "National Victims' Rights Week". This mockery of justice is exactly why victims and their advocates needed to form a special interest group. What we are watching here, folks, is revictimization at it's finest. Good job, Arrellano.

    Thank you Sarah for writing this story. It is a story that needs to be told, the sad truth that these brothers are not mentally retarded, in fact, people who are mentally handicapped are probably sickened to be in the same group as the Apelt brothers. Judge Arellano I believe is "appointed" to her position, rather than voted in. Perhaps we need to contact the Governor's office and ask the Governor to withdraw her appointment. This judge needs to remove herself from this case and allow the case to be heard on it's own merits.

    I am sickened and appalled to learn what a mockery this murderer from Germany is making of the American justice system. The current judge in this case is an embarrasment to our system. I am surprised to learn she is on the bench in the same county as "America's Toughest Sheriff." Sheriff Joe is the best - a true law & order kind of guy. Judges like this one undo and/or undermine all the hard work of LE and D.A.s everywhere with their asinine decisions like this judge had made. Politicians and voters - please take note! Be very careful about who you put on the bench. It appears there are con artists from all walks of life. :(

    I think Judge Sylvia Arrellano is looking to make a name for herself via this case. She knows everything that was written in this article, and more, yet she continually sandbags the attorney general's office. As was stated above, she tried to rule out any testimony about the Apelts after they were adults, when deciding if they were "mentally retarded" or not. She has thrown Cathy Hughes, the original prosecutor who convicted the killing duo, off this case which she was doing pro bono. (Which, by the way, she did behind closed doors in an unethical and illegal manner.) She has also overruled her own decisions. Recuse this judge!

    This entire case is outrageous. Where's the justice for the murder victims and their families? These men are cold-blooded calculating murderers. Who even cares if they are geniuses or mental midgets? They are killers, and as such they are a dangerous duo that would endanger others if ever allowed their freedom. If they win their bid to hoodwink the courts and be declared mentally retarded to escape the death penalty, then eventually they would be eligible for parole. This is a frightening, paralyzing thought, especially for Kathy Monkman and her family.

    I attended the last Supreme Court hearing (at the ASU law college) where they heard arguments about and then overturned Judge Arrellano's previous ruling, which would disallow ANY testimony of the brother's actions or activities after they turned 18. (Meaning the prison guards would not be allowed to testify to how the murderers adapted to their life in prison nor their two escape attempts.) It would also disallow testimony of the actual murder itself, the planning and execution of it and the subsequent cover up. I am STUNNED that this judge is still on the case! Her obvious bias towards the defense is appalling and terrifying to me, as a law abiding citizen.

    I just read for the 3rd time, SARAH FENSKE'S outstanding, yet unbelievable article about Cindy Monkman. I'm shocked! I'm so angry! I'm sitting here, wanting to cry and scream at the same time! I totally agree with Sarah's opinions and I share her emotions about what these 2 bastards are now trying to get away with. I am so saddened by what Cindy Monkman's family must go through now, having to return to court and relive the pain and that hell, after Cindy was murdered by these monsters. Cindy's so-called retarded husband manipulated, married, and murdered her with the help of his brother. Men with IQs higher than 65 carefully and intelligently thought out, planned and performed what they did to Cindy... and everything they did before, during, and after! And now it seems they've successfully conned the Judge and possibly the judicial system? Give me a break! And please, please put my tax money to better use. Please! Thank you, Sarah, for your powerful story. Thank you for informing the world of the details of this case. My sympathy and prayers go out to Cindy's sister, Kathy, and the rest of the Monkman family.
