Bloody Encounter: A U.S. Citizen Says He Hit the Pavement Face-First after MCSO Deputies Racially Profiled Him and Jerked Him from His Truck

When Leopoldo Arteaga asked a Maricopa County sheriff's deputy why he was pulled over last May, he was yanked out of his car and fell face down onto the pavement, bloodying his face, he says.

Arteaga says the deputies never read him his Miranda rights before he was taken to a hospital by the deputies for an injured nose and lip, after which he was taken to the Fourth Avenue Jail. He spent a night behind bars and was eventually charged with criminal speeding and failure to show identification.

Arteaga is 64 years old and a U.S. citizen. He plans a lawsuit against the MCSO, alleging racial profiling and excessive use of force.

The owner of a landscaping business has worked independently in Mesa for the past 25 years. He migrated to the United States from Mexico in the 1970s and became a citizen in 1986, thanks to the Reagan administration's amnesty program. A Mormon, he's been married to his wife, Guillermina, for the past 45 years. They have seven children, 30 grandchildren, and 14 great-grandkids.

Before he was stopped, he had become accustomed to seeing landscaping trucks in Mesa being pulled over by the MCSO. He says he wasn't surprised when deputies pulled over his.

Early in the afternoon of May 12, he says, he was driving on Apache Trail Road and 104th Street at about 45 miles per hour (the speed limit for the area) when he noticed a sheriff's car following him. The deputy pulled him over and asked for identification.

Arteaga asked, "Under which charges am I being detained?"

The officer asked for ID again.

As he reached for his wallet in his back pocket, he says, the officer tried to pull him out of his truck, but the seatbelt restrained Arteaga.

"I didn't expect a thing like that coming from him," Arteaga said, "and when I told him, 'Wait a minute and give me a chance to pull my wallet,' he replied: 'It's too late.'"

Another officer came over, unbuckled the seatbelt, and yanked Arteaga out of the car, he says. He lost his balance and fell to the pavement. His face hit the street face first, cutting his upper lip. They made him lie on the ground for at least 10 minutes, he says.

"They were hunting undocumented people," Arteaga says.

An undocumented day laborer traveling with him witnessed Arteaga getting jerked out of the car, but he didn't want to be identified for fear of retaliation. The worker was handcuffed and taken into a deputy's vehicle. He showed his Mexican identification, or Matricula Consular card.

"I thought I was going straight to be deported," the worker said.

But apparently more interested in a brown-skinned citizen who talked back than an actual illegal immigrant, the deputies released the passenger after he had watched them manhandle Arteaga and peruse his proof of citizenship.

"I think, after what they did, they didn't want any more trouble," he says.

Arteaga pleaded not guilty to the charges, though an MCSO report claims he was driving 20 miles per hour over the speed limit in an area where there were construction barricades and signs that showed the speed limit was reduced to 25 miles per hour.

The report claims Arteaga refused to present ID and did not get out of the vehicle when ordered. It also says he resisted arrest, which caused him to fall on the pavement. Use of force was justified, a deputy named Thompson wrote, because "numerous tools [were] in the vehicle that could be used as weapons."

The deputy said he felt threatened; in fact, he confiscated a loose chainsaw chain (Arteaga uses a chainsaw in his gardening business to cut tree limbs). That was the only "weapon" confiscated, according to the report.

Lieutenant Brian Lee, an MSCO spokesman, dismissed Arteaga's claims of racial profiling.

"It's funny how we're accused by Hispanics of that all the time," he added. "If you're speeding, you're speeding."

Says Arteaga, "If what happened to me isn't profiling, I don't know what is."

    Well--there was an undocumented worker in the vehicle who does not belong in this country!! He might as well had a bag of drugs in the car, both are illegal!! The driver is part of the problem.

Public documentation alone details a man whose political machine has had its hand in murder, rape, kidnapping, graft, blackmail and every possible criminal activity. The scope of the crimes is said to have spurred even jaded republican political hacks at justice to order the FBI into action. When Barack Obama�s people took over at justice the investigation already underway was assigned even more resources and people, revelations surfaced that confirmed the sheriff had allowed individuals with known ties to violent white supremacist and separatist groups to join his armed and badge toting volunteer special deputy ranks. Some suspect the sheriffs more bizarre than usual behavior of late suggest he may be planning an insanity defense or will attempt to have doctors certify he is afflicted with Alzheimer�s and unfit to stand trial.

As for Joe Arpaio, that man will eventually be out of office by force from Washington. It won't be long. What he's doing is unconstitutional. It's sad to say, or even think that Nazis think they will actually make a change. They are ridiculous.

    I know why Maricopa County and the state are so broke. It's because Maricopa County citizens are suing Sheriff Joe, the MCSO and County Attorney Thomas faster than we are taking in revenue. We have shelled out almost $50M in hush money to allow these Constitutional abuses to go on. When is US AG Eric Holder, as well as AZ AG Terry Goddard, going to see what's going on in Maricopa County, Arizona? The Don Stapley case will be thrown out, again. If he is indicted, he will face at most a perjury charge. AG Goddard is supposedly "under investigation". As far as I can see, there is no reason for him to be "under investigation". Sheriff Arpaio, the MCSO, and County Attorney Thomas need to stop wasting my money on frivolous claims and do the jobs I pay their salaries to do. I don't pay Sheriff Arpaio and the MCSO to lease vehicles. I don't pay them to abuse and intimidate citizens of this county. I don't pay Thomas to play footsie with Sheriff Arpaio. I don't pay Thomas to be in bed with Sheriff Arpaio. I pay the sheriff and the MCSO to uphold all local and state laws. I pay the sheriff and the MCSO to serve warrants on felons and keep my streets safe. I pay Thomas to put felons in jail and keep them there. I pay Thomas to zealously represent the citizens of Maricopa County in a court of law. When do the abuses stop? When do Maricopa County citizens get their Constitutional rights back?

A MAN WHO IS LAW ABIDING WITH SUCH A LARGE FAMILY AND BUSINESS RESPONSIBILITIES CANNOT BE REASONABLY SUSPECT. THIS THEN LEAVES THE ACTIONS OF THE COPS IN QUESTION. THE BROWN MAN IS GOING THROUGH MUCH THE SAME ORDEALS AS THE BLACKS FACED FOR SO LONG. WHAT POSSESSES HUMAN BEINGS TO EXPLOIT THEIR FELLOW MAN IS THE QUESTION THAT MAN CONTINUES TO STRUGGLE WITH.     The fact the the MCSO thugs did not roll up the guy that was undocumented says volumes here people. Do you realy think they would just let him go and not add that one person to the numbers they roll out all the time? This is going to come back to huant MCSO, I can only hope cause I sure know this one is going to cost the county a hefty dime!

    This is the latest in a chain of incidents which clearly shows racial profiling, unnecessary physical violence and arrogance on the part of Sheriff Joe's Arpaio's criminal and anti-constitutional leadership. Even after this sorry excuse for a law enforcement official is legally removed from the political office he has hijacked for criminal use, it will take much work and outside intervention to get rid of the institutionalized thuggery that has been cemented in the department. How much longer must we (Maricopa County, Arizona) be disgraced as a racist throw back to the 1950's South ? Racial Cleansing has been and is continuing to take place, while negligent homicides are allowed to continue to take place in Sheriff Aparaio's (wanna be Mussolini) torture chambers? Where is our president and why is he not doing more to investigate these grievous violations of civil rights against American and world citizens?     Joel, I would like to remind you of the MCSO deputy pulled over by Peoria PD, doing 95 in a 45 in his vette on Grand Ave..which MCSO subsequently later took over 6 months later and had the ticket dropped. Anyone of us would have gotten a criminal speeding ticket...i call BS.

    I was once pulled over my MCSO at Horseshoe lake. They told me to get out and take out my id in spanish. I told them i'm native american. And both officers said they don't care if i'm indian or hispanic. Lucky i had my kids with me and they asked if they are U.S. Citizens. So, i told them we have been here for 1,000's of years. Your the imagrant, So, I feel for this person. Nazisium is alive and well in Sherriff Joe's camp.

    I don't think he meant funny as in "ha ha"...I think he meant funny as in "odd". Being accused isn't funny...but it is odd that a person going 45 MPH in a 25 MPH construction zone couldn't possibly be pulled over for speeding...it MUST have been because the cops knew he was Hispanic. The next time you are driving down the road, see if you can figure out what the race of the person in the car ahead of you is. If you're thinking that, because it's a landscape truck, that the driver must be Mexican, guess what? You're a racist. There are plenty of whites, blacks, and all shades in between driving landscape trucks, so I hope you weren't really thinking that. And the story doesn't indicate that this had anything to do with immigration enforcement or a crime sweep. It's just a guess, but I think the cops might have been asking him for his driver's license, like every cop does on every traffic stop, everywhere in the world. Fight the ticket, fight the arrest, say the cops were heavy handed, even, if you think they were, but why jump straight to racial profiling? Funny(not haha, but weird) that this story can be told, and so many of you automatically think it is racially motivated or barbaric, yet there are far more whites in jail than Hispanics. The only difference is that a white guy can't claim it was racial.

    I would like to add that I used to be ashamed at others who grew up here and also supported Our Payaso. But the first letter writer convinced me that the people who I used to wonder about are in fact pussies of the highest order. No one who graduated from high school in this country can claim that what MCSO is doing is morally allowable. These A-holes claim that they are the ones we need to thank because they provide the protection necessary to keep the peace. What a crock and anyone who belives any part of it is stupid beyond belief.

    Lt. Brian Lee thinks it's funny that MCSO is accused by Hispanics of racial profiling all the time? You think that's funny? Sick sense of humor there, Lt. Lee! Personally, I think it's fucking tragic. MCSO gets accused because there is solid ground for the accusations. I think the MCSO's actions are deplorable, abusive and criminal. It's obvious that many of these folks are being pulled over for DWB, Driving While Brown. Lt. Lee, that's called racial profiling. And no, it most certainly is not funny.

    Funny how the MCSO pulled over and abused yet another citizen of this county. I live in Mesa, about 3 miles from where this stop occurred and the speed limit on Apache Trail/104th is 50MPH. In fact, there is NO CONSTRUCTION going on at this intersection. Go Aratega! Show the MCSO who's boss!
