An Opportunity to Stand Up

Village Voice Media is underwriting the cost of the American Civil Liberties Union of Arizona's forthcoming litigation against Senate Bill 1070, as well as two other immigration lawsuits.

Senate Bill 1070 mandates that a police officer who has "reasonable suspicion" that someone is a Mexican must detain that person. The cop must ask: Are your papers in order?

Similar legislation is under discussion in seven other statehouses.

Arizona has chosen to insist that all law enforcement in the state adopt the police-state tactics of infamous Sheriff Joe Arpaio.

Beyond the issue of immigration, Village Voice Media's journalists in Phoenix have been targets of the sheriff. Writers, editors, and our publisher have been stonewalled and harassed. The pursuit of public records has led to the filing of criminal charges against a reporter. The entire editorial staff was the target of a criminal grand jury, and the identities of our online readers were the subject of a subpoena. That particular fight led to the arrests and jailing of New Times founders Jim Larkin and Michael Lacey.

The lawsuit from those arrests is in the appellate court.

For the past couple of years, Village Voice Media's newspapers have helped finance the ACLU's efforts to protect the rights of immigrants. Much work beyond the lawsuit remains on the immigration front.

With Governor Jan Brewer's April 25 signature affixed to Senate Bill 1070, Arizona is poised to direct all law enforcement agencies to adopt Sheriff Joe Arpaio's policy of rounding up and incarcerating Mexicans and then shipping them back across the border if they lack proper documentation of their status in America.

Arpaio's sweeps include deputies in black ski masks to underscore the tone of terror.

The new law, sponsored by former sheriff's deputy and current state Senator Russell Pearce, is, as a matter of fact, part of a national attack on Latino immigrants coordinated by FAIR, the Federation for American Immigration Reform.

Authored by FAIR's Kris W. Kobach, a controversial former Justice Department attorney under John Ashcroft, similar legislation is poised to be introduced in seven other states: Texas, Missouri, Oklahoma, Utah, Pennsylvania, Ohio, and South Carolina.

Senate Bill 1070 instructs police officers to demand proof of citizenship from anyone they have a "reasonable suspicion" may be in the country illegally.

Critics point out that the new legislation allows individuals to be stopped absent criminal behavior. The demand to know whether a person's papers are in order smacks of an authoritarianism not seen in this country in recent memory.

"Nazism," observed Los Angeles' Catholic archbishop, Cardinal Roger Mahony.

Such vivid, and vitriolic, reactions were not limited to the devout. Phoenix Mayor Phil Gordon announced he would file a lawsuit on behalf of the city challenging the legislation. Intent to litigate was also announced by the American Civil Liberties Union of Arizona, the Mexican American Legal Defense and Education Fund, the National Coalition of Latino Clergy and Christian Leaders, and two police officers, one each from Tucson and Phoenix. (Mayor Gordon could not secure the majority of the Phoenix City Council necessary to move forward legally, but he continues to speak out.)

Because the state has usurped federal authority over immigration, the legislation is open to a constitutional challenge.

More troubling is the fact that racial profiling is the very foundation of Senate Bill 1070. The Equal Protection clause of the U.S. Constitution prohibits selective enforcement based upon race. All Hispanics, no matter their citizenship, will be subjected to a police state that applies to no one else. No one else at all.

Driving While Brown now joins Driving While Black — not simply in the vernacular of human beings targeted because of skin color by law enforcement but also in the law books. Arizona, which at one point repealed the Martin Luther King Jr. holiday, appears determined to stake out racial frontiers.

Although Senator Pearce's name is on the bill, it is not surprising that the legislation is so heavy-handed racially, given the role of FAIR in drafting the contents. The Southern Poverty Law Center identified FAIR as a racially driven organization.

In 1986, FAIR's founder, John Tanton, wrote: "As Whites see their power and control over their lives declining, will they simply go quietly into the night? Or will there be an explosion?"

Kobach, while at Harvard, fell under the sway of Professor Samuel Huntington, according to research by Kansas City journalist Carolyn Szczepanski.

In his 2004 book, Who Are We: The Challenges to America's National Identity, Huntington claimed immigration, particularly by Latinos, threatened American culture.

Writing in the Kansas City-based alternative newsweekly The Pitch, Szczepanski noted that Kobach does missionary work in Africa, where he distributes Bibles to "people who live in huts, who have no written material whatsoever."

Kobach's proselytizing allows him to instruct Africans in "Christian and universal values."

We know precisely what the impact of Senate Bill 1070 will be upon the streets of Arizona because of a little-noticed settlement in a lawsuit brought by the American Civil Liberties Union of Arizona.

In 2001, Flagstaff attorney Lee Brooke Phillips and the American Civil Liberties Union of Arizona sued the state, charging that the Department of Public Safety — the highway patrol — engaged in rampant racial profiling.

John Lamberth, a Temple University professor with expertise in racial-profiling research, produced data in 2000 that showed African Americans made up fewer than 3 percent of traffic offenders but 43 percent of all stops by the DPS.

Based upon this study, the court ordered the highway patrol to turn over all data on traffic stops in northern Arizona for a one-year period.

What happened next made seasoned observers blink.

Instead of turning over records, records were destroyed.

"Look, the judge ordered the state to turn over a year's worth of records, and the state's prosecutor's office refused to turn them over," noted Phillips in an interview at the time with an advocacy group. "We learned they weren't turning them over because half of them have been destroyed."

Arnold vs. Department of Public Safety reached a historic settlement in 2006 with a federal court's approval.

The settlement, among other provisions, required the DPS to collect information on all traffic stops between July 1, 2006, and June 30, 2007.

Of the 200,000 traffic stops made on Arizona's interstates during this period, 13,271 ended with a vehicle search.

According to the study: "On average, Native Americans stopped by DPS officers were 3.25 times more likely to be searched than whites stopped by DPS officers. African Americans and Hispanics were 2.5 times more likely than whites to be searched by the DPS.

Obviously there is a huge difference between the two situations. To be more clear to your readers, simply replace your phrase with the phrase 'if they are illegally in America". That will be less confusing to your readers.

    I just can't resist making one more comment. Did you know that California law is virtually identical to Arizona's? Most laws are no longer enforced in San Francisco of course, which is reflected in the rapidly depreciating quality of life there. For those who have never compared the two (and from the looks of it this journalist never has) here are both laws side by side. Perhaps we should boycott bankrupted California as well: Arizona immigration law states: (1) Where reasonable suspicion exists that the person is an alien who is unlawfully present in the United States, a reasonable attempt shall be made, when practicable, to determine the immigration status of the person. (2) The person’s immigration status shall be verified with the Federal Government pursuant to 8 United States Code Section 1373( c ). If an alien who is unlawfully present in the United States is convicted of a violation of state or local law, on discharge from imprisonment or assessment of any fine that is imposed, the alien shall be transferred immediately to the custody of the United States Immigration and Customs Enforcement or the United States Customs and Border Protection. California immigration law states: (1) Every law enforcement agency in California shall fully cooperate with the United States Immigration and Naturalization Service regarding any person who is arrested if he or she is suspected of being present in the United States in violation of federal immigration laws. (b) With respect to any such person who is arrested, and suspected of being present in the United States in violation of federal immigration laws, every law enforcement agency shall do the following: (2) Attempt to verify the legal status of such person as a citizen of the United States, an alien lawfully admitted as a permanent resident, an alien lawfully admitted for a temporary period of time or as an alien who is present in the United States in violation of immigration laws. The verification process may include, but shall not be limited to, questioning the person regarding his or her date and place of birth, and entry into the United States, and demanding documentation to indicate his or her legal status.

Senate Bill 1070 says the exact same thing as the federal immigration law does and does not in any way single out Hispanics. The only way in which Mexico would be singled out is that they currently supply about 51% of all U.S. illegal aliens. Which brings me back to my first question. What do you get out of attempting to strong-arm a state into bending to your will? California gets completely bent out of shape when they are asked to conform to Federal laws, so why should you have the right to do so to others? Racism is a ruse here - the U.S. once had a fairly even distribution of income according to the GINI index, but now it has the worst OF ANY NATION IN THE WORLD! Guess who is number 2? (Hint: it's Mexico). The Mexican government benefits by encouraging its poor and darker skinned to flee the country to the U.S. and the U.S. power elite benefits from a flood of poorly educated, desperate people from a corrupt military dictatorship (democratic only in name, much like the U.S. now)whose votes can be bought.     This story is once again; highly incensing, accusatory, and not entirely factual. But; this seems to be the norm with a liberal biased reporter I suppose. The fact is, that the officers are held liable. They cannot bother you or even approach you unless you are visibly committing a crime. Only after they have you placed under arrest may they even "inquire" as to your status, if they detect that you "MIGHT" be here illegally. If you furnish a drivers license, or some other stuff, there usually isn't a problem. But if you can't produce a valid license or other documents, then you are subject to detention to determine your status. If they determine your illegal, they then must hand you over to the INS people. The problem is that so many liberals; along with Mr. Obama and many other in the democratic side of the houses, want open borders. So they scream like this; and whine like this to muddy up the discussion. The fact is you can't have open borders without breaking the constitution. So this will be a very embattled front for years to come between liberals and conservatives. Meanwhile; the schools are churning out these "journalists" who have more bias than an NPN transistor with 12 volts on the collector and base, and emitter at ground! In lay terms; that means saturated! Three words here. Read The Law! For those that read it, and compare to federal law, they quite literally mirror one another. I read them. How about you?

    wow, talk about HYPERBOLE. The law merely mirrors what Federal says. The police are allowed to do no more than they already do anywhere else, including Minnesota, where we are required to produce identification if pulled over for running a stop sign, for example or are already in commission of a crime. They can't just go up to anyone for no reason and ask for their id. Please stop lying and trying to scare everyone.

    My wife is a legal immigrant. I am white. She is from a non-border country. I went thru many whoops and a lot of time and money to get her here legally. I had to vouch that I would pay for her and not let her use the "government system" for anything. She is now a US Citizen and proud to be here. I am insulted that people are saying that the people who come and stay here ILLEGALLY have rights. It is an insult to every person who does THE RIGHT THING. I am all for immigration, but legally. Another thing... my wife works AND pays taxes, is happy to pay them because America is giving her what her country could not... a chance for a better life!

CCA has also been a long-time funder of the American Legislative Exchange Council (ALEC)and memberof its Private Sector Executive Committee, which advocates on behalf of CCA to push prison privatization as a model for states. While most believe prisons are operated by state or federal governments, they are increasingly privatized. As the number of immigration prosecutions continue to skyrocketand comprehensive immigration reform languishes in Washington, DC, this makes the business of operating prisons all the more lucrative for private firms. According to the Transactional Records Access Clearinghouse (TRAC), immigration prosecutions reached record levelsin federal fiscal year 2009. The Department of Homeland Security initiated 67,994 immigration prosecutions that year alone, a 459 percent increase from 2000 and a 973 percent increase from 1990. Filling Up Prisons with Non-Violent Immigrants: In addition, federal immigration authorities are increasingly targeting nonviolent immigrants, whose only offense is attempting to unlawfully cross the border, via efforts such as Operation Streamline, which focuses on apprehending nonviolent border-crossers. According to a May 2010 studyby the Warren Institute at the University of California, Berkeley Law School, projects such as Operation Streamline that focus on immigrants who haven't committed any crime in the US divertprecious federal resources from apprehending drug cartels and human traffickers that frequently operate with impunity along stretches of the US-Mexico border and are responsible for much of the violence in the region. These record numbers of nonviolent immigrants are, in turn, filling jails and immigration detention centers to capacity: contributing to growing costs to states and higher profits for private prison companies like CCA. The Failures of Prison Privatization: Both federal and state governments have utilized private firms to operate prisons, despite evidence of systematic failures. Privatization only exacerbates the challenges faced by states, communities, and families dealing with the broken immigration system. For example, the Florida Center for Fiscal and Economic Policy findsthat there is no compelling evidence that prison privatization has led to savings, while the Private Corrections Institute analyzes several issueswith privatization, which include “major riots, sex abuse scandals… improper billing by private prison companies… employment law violations, higher employer turnover rates, increased levels of prisoner-on-prisoner and prisoner-on-staff violence, lack of transparency and public accountability, and higher recidivism rates for inmates released from privately-operated prisons.” When privatization involves prisons and detention centers, the profiteering comes at the expense of constitutional safeguards, democratic oversight, and public trust. In this case, it also undermines legislative efforts to promote progressive immigration reform. Lawmakers should take action to prevent such debacles from occurring by either halting failed privatization schemes. For example, Indiana Rep. Gail Riecken's introduced a billto end privatization of social services in her state. Legislators can also consider requiring augmented transparency of state contracting, much like initiatives in Alabama, Hawaii, and Vermont.     1st I'm HISPANIC and I'm in favor of upholding the law. Yes, MEXICANS were here before some of the territories became states but they're not their territories. Its like if I sell my house and expect the new owner to just let me continue to live there and come and go as I please. Also, no one has asked the Mexican president how his country handles people coming into Mexico from other countries trying to get north to cross the border. Many men have been tortured and killed by Mexican police and coyotes. Growing up in NY "la migra" would come to factories and apartment buildings asking for everyone's papers and if you had them then you were left alone if not they rounded you up and deported you, this is back in the '70s so this is not new. If you have your papers in line and have nothing to hide then it shouldn't matter. By hiding your undocumented "relatives" and friends YOU ARE committing a federal crime. Mexicans shouldn't have special treatement because no other Central or South American country does and unfortunately the majority of immigrants are Mexican and that makes it bad for the rest because the GRINGOS can't tell us apart to them we're all Mexican.     Legal Vs Ethical SB1070, appears on its surface to be legal and until I hear otherwise from a federal court, I'll concede that. That doesn't mean it's ethical. Clearly, there is an ethics dispute between those who agree with the law and those who oppose. The issue of real ethical concern is police protection. No society can afford an environment where a segment of the population has limited access to police protection because it targets that population for victimization by other criminals. This is the reason why enforcement of immigration is best left to the Federal Government. If SB1070 is not repealed and local law enforcement does not concede the enforcement of immigration laws to the federal government then what can an illegal immigrant female do if she suffers from domestic violence, rape or forced prostitution? The law provides that the police should not attempt to determine race if it impedes an investigation but the section providing this point is clearly under written and ambiguous. Regardless, I am unconvinced that under the current adversarial relationship, the victim would seek police protection. Moreover, many children of illegal immigrants are full citizens and should be respected as such but as minors to illegal immigrants, they also cannot seek police protection for fear of disclosing the identity and legal status of their guardians. I am not looking forward to the inevitable day when we discover that SB-1070 and child prostitution, rape, abuse and intimidation are business partners. We are citizens of a modern democracy, not ruthless animals. The law is an abhorrence because it is a gift to our cities most violent criminals and gangs.     Hey Michael I just wanted to comment briefly on your article entitled “Hopeless”. First of all you state that Mexican immigrants are part of “the fabric of this nation”. Of course this is true. Immigration from all countries is part of the fabric of this nation. Nobody says immigration has to stop. Just do it legally. You refer to illegal immigration as a “so-called” problem. As a resident of Arizona I find that statement insulting. All of the statistics regarding the problems are very easily verifiable. Statistics on crime are public record. The immigrants drive up our health and auto insurance. They cost this country and state millions of dollars in public services and pay minimal taxes in return. Every cent of taxpayer money that is spent on the citizens from another country is money that could have gone to helping our citizens. You make reference to studies on racial profiling, many of which didn’t even occur in Arizona and they were prior to SB1060. This is an issue with the performance of the officers involved, not the laws that they enforce. Much of the emphasis of the article is dependent on your statement that SB1060 allows law enforcement officers to stop anybody due to the color of their skin. I have to assume one of two explanations for this statement. Either you did not read the bill or you are lying. The bill clearly states that there first must be a legal stop. The addendum to the bill makes it very clear that racial profiling is illegal and makes reference to the federal law that makes it illegal. If racial profiling occurs after the bill it’s not because of the bill, it’s despite the bill. Legal stop, reasonable suspicion, then check papers. There is a serious problem with illegal immigration and race is an aspect of the problem but it is not a problem due to race.     As a life long resident of Los Angeles, I say good for Arizona. Arizona has a standard of Living to protect. Los Angeles in my childhood was a beautiful, vibrant city; now it's a third world hellhole. Illegal's come here because Mexico is in such bad shape, meanwhile the drop population bomb's on our school's hospitals and infrastructure, turning everything into Tijuana crap. Yes they work hard, and just want better lives, but at the expense of our lives and our job's. You cant even get a fair wage or a descent job in Los Angeles because 1,000,000 illegals well do the same job peanuts. I actually like Mexican's and have always lived in Latino neighborhoods, but they need to start wearing condoms and stop jumping the fences.     There is little question that regulating immigration is exclusively a federal prerogative. That is why a statute like 8 U.S.C. § 1357(g) is necessary to allow local law enforcement to collaborate with INS in limited circumstances. While I understand the argument that the Arizona law isn’t enforcing immigration policy/law, the courts probably won’t see it that way. But the hyperbole about "Nazis" and "totalitarians" is infeasible. It is not unconstitutional to require aliens to possess registration papers; federal law already requires as much. 8 U.S.C. § 1304(e) (“shall at all times carry with him and have in his personal possession”). Pretty much every country in the world requires this. There is nothing inherently unconstitutional about authorized law enforcement agents investigating someone’s right to be in the country. Again, federal law already does this: an INS officer may, without a warrant, “interrogate any alien or person believed to be an alien as to his right to be or remain in the United States.” 8 U.S.C. § 1357(a)(1). Courts regularly uphold the Constitutionality of this statutory scheme. Likewise, the Supreme Court has frequently defined “reasonable suspicion,” so that is hardly a novel concept to any legal professional, including those at the ACLU. I don't doubt that New Times would abolish even the federal immigration laws and Supreme Court precedent mentioned above. It is absurd, however, to suggest that the Arizona law does something beyond the pale.

    I do believe that having a sustainable wage job is a human right that does supercede international boundaries. I think that many unemployed U.S. citizens are coming around to that point of view. However, we pay taxes. Those taxes are used in part, to create the social safety network for us if and when we become needy. However, since the 1970's (according to what a DES worker told me) those payment amounts and qualifications have not been revised to reflect true economic conditions. Meanwhile many citizens have been denied access to those services, especially life-saving healthcare, which was given to illegal aliens instead. This means that the US citizen has been denied the benefit of their own work which means that we are slaves to a system that no longer serves us. Because only slaves are denied the benefit of their work. So many of us have already given our very lives so that you could live and work here illegally and it is wrong to steal from us to support you. Therefore our human rights have also been violated. The Republic used to publish articles about this so it is not a bogus undocumented claim. For you to use some things that happened 500 years ago to fight us now is absolutely ridiculous. Everybody has evolved since then in thought and in racial purity. Most of us are mixed race and this has probably been going on since the beginning of time. There are many Europeans who bear the genes of the Mongol invasion so long ago. Are they now going to sue the Mongol nation for restitution for the rapes that occurred so many centuries ago? Are Jewish people going to get restitution from Russia for the pogroms? Since you are going back 500 years - are Arabs going to take Spain to court for ousting them in 1492? I find what you are doing to be ridiculous. Admittedly several decades ago I found Arizona horrifying in the prejudice department but times have changed, the population has grown dramatically with people from all over the world re-settling here, not just Europeans. The ignorance that I have seen associated with the charges are just phenomenally stupid. Even to boycott "white owned" business like Bashas. I don't know the Basha's personally. I do know they are of Arabic descent. They are not white. I am sure they have and still do suffer great prejudice from certain sectors. Just because they managed to grow a big business does not magically render them white and therefore worthy of destroying. Hispanic peoples have had many wonderful benefits under our current system of employment. They can get hired under affirmative action claiming minority status. Everybody is sick of all this racial racial racial crap. At this point in time in the worlds history we see that we are owned by the corporations and the banksters. Things have gotten way out of control in favor of the corporations, who were once here to serve us but now have taken on a life of their own and we exist merely to serve them and if we get ill, or they mutate and do not wish to bear the cost of retraining us, or any of a myriad of other possibilities, they throw us away and most of us use everything we acquired our whole lives trying to get a sound footing again. Corporations make money off of us every which way and they do not mind poisoning the environment because they take out peasant policies on us and get paid handsomely if we die. Basically all the humans on earth are in this battle one way or another and this battle that you are presenting is just proving you to be stooges of the hidden hands behind our problems. It serves their purpose to divert us with this huge battle that you want and prevents us humans from being united in other battles that are occurring right now, that effect all of us regardless of race or nationality and deserve our undivided attention. Not this. Recently there was a poll/survey done asking us to submit our favorite local business. How can I? There are only chains except for a few local Mexican and Chinese restaurants. Does a local branch of a chain count as a local business? Not in my book. However, if you persist in this action perhaps I will consider a counter-boycott and will stop patronizing local Mexican restaurants. AS I was looking through the actual PDF of the law I noticed that almost every was defined to a very fine degree except for what constitutes the key initiation factor "REASONABLE SUSPICION". No where are there any parameters to establish what constitutes "REASONABLE SUSPICION" A quick Google comes up with : Reasonable suspicion is a legal standard in United States law that a person has been, is, or is about to be engaged in criminal activity based on specific and articulable facts and inferences. A "ah hah" also turned up in that same search. Courts have ruled (Terry v. Ohio, 392 U.S. 1 (1968)) that a stop on reasonable suspicion may be appropriate in the following cases: when a person possesses many unusual items which would be useful in a crime like a wire hanger and is looking into car windows at 2am, when a person matches a description of a suspect given by another police officer over department radio, or when a person runs away at the sight of police officers who are at common law right of inquiry (founded suspicion). However, reasonable suspicion may not apply merely because a person refuses to answer questions, declines to allow a voluntary search, or is of a suspected race or ethnicity.. So we have a little conundrum. How do we tell who is probably a "alien" in the US illegally when the courts do not allow the fact of someones race or ethnicity to be part of the "REASONABLE SUSPICION" used by the member of "LAW ENFORCEMENT OFFICIAL OR AGENCY OF THIS STATE OR A COUNTY, CITY, TOWN OR OTHER POLITICAL SUBDIVISION" But since the aliens when they are aliens will not have access to public defenders to suppress illegally obtained search results (yes the police/LE WILL use race as the primary factor no matter what any one says) they will get the shaft in the legal sense. But since RACE will be used and some of those stopped will BE citizens and have access to lawyers then they will have "REASONABLE SUSPICION" tossed and then THEY can start the procedure to have this legislation in its entirety declared invalid. This all balances on "REASONABLE SUSPICION" and when "REASONABLE SUSPICION" pulls over too many Citizens then either the whole thing gets tossed or a more clearly defined set of parameters will be force to be put in place. Then time will just keep narrowing down those parameters as more and more of those same parameters are attacked as being to "RACE" specific. It really does appear as if logically this law will fall due to the same vagueness that it's drafters were counting on making it hard for Aliens to overcome. Just my observation though.

    I always wonder if these problems are so unresolveable that we will actually have to wait until we have the science developed enough to derive law from true history? Will we need to have a time machine so we can go back in time and see what really happened? Personally I have always told people in my sphere to quit knocking Mexicans - while we in the U.S. were growing in other ways they were busy creating an entirely new race of people with the Europeans and Indigenous intermarrying but now that I have seen the sites posted previously I realize that they only want to honor their Indigenous heritage and not the European part? Damn! Sounds like prejudice to me! And the worst kind - to have to reject a part of yourself! Reminds me of the growing pains during the African-American Civil Rights movement in the U.S. - when light-skinned negroes of mixed blood were rejected by their community until they caused enough harm to some white people to qualify as being black enough - kind of like gang initiation. Nobody needs to argue with me about it because I managed to live through it. It is a painful part that people do not care to admit but it did happen. It would be easier to pretend that the community was always accepting of all of its parts but that was not the way it was. I myself am mixed race and I also have difficulty with rejecting the parts of my ancestry that persecuted the other parts. However, I look white. I receive lots of prejudice from people like Al Blinded By the Light Sharpton as well as illegal aliens from Mexico. Little do they know that I have African-American uncles, in-laws, cousins or nieces. Little do they know that one of my immediate family lived in Mexico and worked with Diego Rivera making the murals. All they see is my light color and they hate.     Arizona is a good place to live and a beautiful place to visit. Recently I’ve been in show low, payson, flagstaff, casa grande, florence, coolidge, san tan valley, williams, safford, phoenix, surprise, laveen, maricopa and other places in between. I yet to see any of the violence that pearce has used to put fear in many in az. No 67 deaths in az due to violence in one day or any given day, no cops getting killed everyday by hispanics, and crimes occurring on every block like pearce and arpaio have scared residents into believing. Making people think that they occurred in the us but 0 occurred in the us. Some of those murders occurred in mexico city that day. Further he claims that 67 percent of cops killed were killed by illegal aliens but he has no proof nor does the fbi phoenix pd or dps. Also surveys they did included mostly whites and have been used to make it seems that 1070b is widely supported. They even have gone out and said that Hispanics support it when almost all Hispanics oppose it. This is how pearce tricked az to pass the 1070b along with other dubious tactics. All this so he can keep az white and prevent any non white race from having any power. As for the drunken, stupid claim that the law violates the 4th Amendment, Rednecks Suckmytaint should review the U.S. Supreme Court’s 2005 Mena v. Muehler, where the court, on a 4th Amendment claim and in an unheard of 9-to-zip, said essentially that asking about immigration status by local police is legal and as basic a question as asking for name, address and date of birth. Keep in mind that justice Ruth Bader Ginsberg, the former chief council for the national ACLU, was on that court. Rednecks Suckmytaint, I strongly urge you to get some much needed help for you condition. Swilling down booze and eating stupid pills (probably somewhere in a “white-trash trailer park”) does not a good life make. And so it is.

Also I have been upset at my U.S. citizen brethren for years for using the word "American" to mean the U.S. and the word American to mean the U.S. citizen since any Canadian, Chilean, or Panamanian can also say they are American with complete sincerity I think that you all must think we are quite narcissistic or ego-centric to use that word in reference to US citizens only. If I am right, have you got another suggestion for a substitute word?

Some of the wording goes like this SUFFICIENTLY VIGILANT IN ENFORCEMENT AND FORBIDS ANY CITY FROM IGNORING THE STATE LAW AND BECOMING A SO CALLED SANTUARY.     As for Mr. Lacey's bullshit article, SB 1070 is nothing more than the federal immigration laws. AZ took the federal laws and made them state laws. The law does NOT require cops to "stop anyone they think might be here illegally" as Mr. Lacey FALSELY claims. There will be no stopping and harrassing anyone. The only part of the bill that mentions race says that race cannot be used to be suspicious! - Lacey calls profiling the "very foundation" of the bill. Again, bullshit. The bill strictly prohibits profiling. But keep playing that race card. - 82% of the complaints about police aggression come from minorities in the South Mountain precinct. Sounds about right, Hispanics and blacks probably make up at least 90% of the crime in South Phoenix. - Arpiao said months ago "if they look like they came straight out of Mexico" - what's wrong with that quote? An illegal immigrants are coming straight out of Mexico, and that's our problem. - You mention Christianity a lot, and "Christian values" - what does that have to do with anything? Can you liberals please make your mind up? Is this a Christian nation or not? Over the decades that we have attempted to erase prejudice and embrace diversity it seems that the divide has just gotten bigger and people self-segregate into their separate communities? I am horrified to report that even in this new century we parents of multi-racial kids still see prejudice and ostracism from people of each ethnic group towards our mixed kids. Why do we need to embrace a people who have broken our laws and shown us the hate? How is that going to encourage them to change and embrace our values of respect for others by rewarding them for not doing so? Let's simplify to respect for others. We can add culture, race, ethnicity, religion, laws to the end of that.

    Ive been very involved in the marches against this unjust law , Im the guy carrying the Martin Luther King picture in the marches My reasons for being involved are not that im hispanic but that my kids and grandkids are . And will live in a world reminisent of the 50s seggregation and the like. But my comment is maybe off the subject but right on the subject of racism and maybe not many people put it together like I see it. But here is a classic exammple of this racism against Mexicans and hispanics in general. A few years ago a hispanic mother was arranging for a car pool ride when one of her children drowned in a tragic accident. Im sure New Times remebers it. She was arrested and charged with a crime and spent time in jail for letting her child drowned in this accident.. Since then many drowings in Phoenix have taken place one yesterday no charges have been filed against anyone "white" who baby drowned !! The lady yesterday was checking her E-mails while her baby drowned. Is it just hispanics who get charged if their baby drowns?? While the mom is neglecting their job as a mom??This is the pattern I see.

I was in Phoenix (friends in Tucson refer to it as "The Evil Empire") last fall, and my truck was broken into in a lighted parking lot while I was away from it about five minutes; a stereo was ripped from the dashboard. A shopkeeper said, yes, I could call the police, but since this was at the edge of a large Hispanic and American Indian community, they'd do nothing about it. I now carry my US Passport anytime I'm visiting or crossing Arizona. Previously, while driving legally alng I-8/I-10 in California-licensed vehicles, I was twice stopped and my driver's license was deemed not enough proof of citizenship, but I was let go. Oh, I am a light-skinned, blue-eyed person with no Hispanic roots.

Francophones would be screaming "Arrêt!" and "Non!" to illegal immigration at the top of their lungs. Canada 's leading pundits and politicians would be demanding the preservation of Canadian culture against the onslaught from the United States . All of the obnoxious moral priggishness about "human rights" and "multiculturalism" that Canada has become so famous for would go out the window in a heartbeat, and the Canadians would spare no expense in rounding up and deporting the illegal American invaders. French-Canadians are extremely prickly about their cultural heritage. Quebec has legislatively forbidden stores to advertise in English and mandated the use of French in public schools. French-Canadians have their own political party, the Parti Quebecois, to promote their interests. In 1995, the province held a referendum and came within one percentage point of voting to secede from Canada . It is utterly mind-boggling to see the reaction of the cultural and political elites in the United States to the law passed by Arizona last week empowering the state to enforce immigration laws. Cardinal Mahoney of Los Angeles characterized the law as "Nazism," and Secretary of Homeland Security Janet Napolitano called it "misguided" and "not ... good." The Constitution grants Congress the authority to "establish a uniform Rule of Naturalization" and to "repel Invasions." But prominent congressional leaders like Speaker Pelosi and Congressman Raúl Grijalva have taken positions opposing the enforcement of the immigration laws Congress itself has passed. Even the president has criticized Arizona 's law, calling instead for granting citizenship to illegals. What else would you expect from a president who spent his childhood in Indonesia, bowed to foreign emperors, gave a campaign speech as a citizen of the world in Berlin, and who currently has an aunt living as an illegal alien on welfare in Boston? Certainly it is unrealistic to expect that he will serve the interests of the United States . No sane country has ever elected elites who have systematically undermined their own culture and erased their national borders. Even the French-Canadians know how to stand up for themselves. Who will stand up for the United States and demand, without apology, that the border be sealed and the illegals deported? The Republicans won't do it, the Tea Party is impotent and rudderless, and the Democrats are actively aiding and abetting those who seek to undermine us. If we are unwilling to police our own borders, we are doomed. I'm not certain what it will take to preserve the United States , but we had better come up with something effective -- and soon. As long as the Europeans are in the majority, they can illegally invade an entire continent's tribal lands and call it "manifest destiny" and say it was God that led them righteously into the lands of others. The benefits of that 1492 invasion (raw materials, productive land, indegineous low wage workers etc.) still falls at the feet of the citizenry of the U.S. The White Europeans thought they would always be in control of their destiny as a distinct group of people, so arrogant were they. The civil war was the height of their arrogance as death and destruction always is the end of arrogance.
