Regarding Birthright Citizenship, What Is It About the U.S. Constitution That Nativists Don't Understand?

Of all the un-American schemes to pop from the cranium of neo-Nazi-hugging state Senator Russell Pearce, his plot to deprive American-born children of birthright citizenship, as guaranteed by the U.S. Constitution, is clearly the most despicable.

Pearce has been pushing to subvert the citizenship clause of the Constitution's 14th Amendment for years now. In 2008, long before he made international headlines by bullying Senate Bill 1070 through the Arizona Legislature, he proposed the nefarious idea along with a number of other Nuremberg-type laws.

One such proposal would have denied marriage certificates to couples unable to prove their American citizenship. In Russell Pearce's vision of an apartheid America, only American citizens would be able to marry American citizens.

Maybe that'll be next on the agenda, after Pearce, riding his plan to deny birth certificates to American-citizen children unless at least one parent is a citizen, wins a seat in the next session of the Legislature.

With Arizona's body politic so riddled with hatred and intolerance, such a bill probably will end up on Governor Jan Brewer's desk, and as she's drunk so deeply of Pearce's poisoned home brew, she's certain to sign it. (Sorry, Democrats, I'm not delusional enough to think that gubernatorial candidate and current Attorney General Terry Goddard will pull out a win against Brewer in November.)

Never mind that in signing such a bill, Brewer would once more plunge the state into a torrent of vilification and outrage that would make the boycotts and protests surrounding SB 1070 seem like a birdbath by comparison.

The law would be as unconstitutional as a Communist dictatorship, would be doomed in the courts, and would involve a costly and protracted legal battle.

But Brewer — whose highest educational accomplishment is a certification in radiology — is just dumb enough to let her pandering to the nativists overrule any flicker of common sense she might possess.

Unfortunately, things have gotten far worse than just this sad Sand Land state of affairs.

The Grand Old Party, the party of President Abraham Lincoln, the very party that conceived the 14th Amendment in the aftermath of the Civil War as part of the foundation of a new America, has imbibed Pearce's nativist hooch.

U.S. Senate Minority Leader Mitch McConnell wants hearings on the 14th Amendment, and GOP Senator Lindsey Graham of South Carolina would like to propose a constitutional amendment to prevent illegal immigrants from crossing the border to "drop a child." You know, like a dog, or Graham's mom.

Our own Senator John McCain stared into this abyss, suggesting that he might go for 14th Amendment hearings, too. Then, he stepped back. He now says he wants to stay focused on "securing the border."

The real local traitor to the Constitution is Jon Kyl, our pseudo-intellectual junior senator. He jumped aboard the doomed skiff to oblivion on national TV, telling CBS' Face the Nation that he first suggested the idea of 14th Amendment hearings.

"The question is, if both parents are here illegally, should there be a reward for their illegal behavior?" he wondered on the show.

This, from a guy who once worked across the aisle in the Senate on "comprehensive immigration reform," a phrase now more reviled in Republican circles than "child molestation."

If Kyl were up for re-election, you could argue that he's taken up Mexican-bashing for political gain. But Kyl doesn't have to worry about that 'til 2012, when — who knows? — he may be pimping himself as a moderate again on immigration.

For now, however, he is slime personified. There's no idiot politician I'd like to smack upside the skull more. More even than Russell Pearce. And that tells you something.

SOLDIER'S STORY

Fortunately for some Republicans, Pearce's loathsome notion of restricting citizenship to those born to at least one American parent is not being proposed retroactively.

That, by the way, would be unconstitutional, too — but never let the U.S. Constitution get in the way of a racist concept, right?

Among those who would be affected if this war on immigrant children were applied retroactively, would be a rising Republican star, Louisiana Governor Piyush "Bobby" Jindal, whose parents came to this country from India on student visas, according to the New York Times.

Since being outed as an "anchor baby" in an opinion piece published on the Web site of the Service Employees International Union, Jindal's flacks have countered that Jindal's mom was actually a permanent resident. But that wouldn't cut it in Pearce's bizarro world.

Recently, the nonpartisan Pew Hispanic Center reported "4 million U.S.-born children of unauthorized immigrant parents resided in this country in 2009."

Based on U.S Census Bureau stats, the center found that 340,000 of the 4.3 million babies delivered in the United States in 2008 alone were what nativists objectify as "anchor babies."

The "anchor baby" slur is a misnomer for a lot of reasons. A U.S.-born kid would have to wait 'til he or she turned 21 to sponsor Mom or Dad for legal residence. Until then, Ma and Pa could still be booted from the country.

Numerous studies have shown that the overwhelming majority of undocumented people arrive in the United States illegally for economic reasons, not to have children.

In the founder's historical documents and after the ratification, since it was written "for us and our posterity" it took either one or both parents to be natural or naturalized citizens in order for the children to be considered "natural or native born." And minors actually had no "citizenship rights" at all until they reached majority, and they intended that to be 25, if you read the Constitution, which is when they would most likely then be property or land holders. American children aren't truly "citizens" for Constitutional purposes insofar as crimes, punishment, or rights until they achieve adulthood. Period.

Obviously writer Lemons has no idea of the history of the 14th amend - it had nothing to do with illegal immigrants - it was passed/ratified because former slaves were being discriminated against by southern states after the civil war. Lemons interp is from a supreme court justice and is completely out of the context of the 14th amendment. How a legal citizen can be derived from illegal, undocumented people defies all logic.

It doesn't have to be written, since the Constitution is a contract the "intent" of the provisions are to also be used when interpreting. Go to the National Archives. The "intent" of the 14th had to do with the 13th, and the slavery issue only. It was to redress what the founders had argued over insofar as slavery, and since most of the slaves were brought her unwillingly, it was to grant their children birthright citizenship as "foreigners" born here of captives. So please get a grip.

I don't know where Stephen Lemons get this information from. Really???? He really doesn't think that "Anchor babies" are a problem in the state of Arizona, Really? I guess he has no idea of what he is talking about then. The state of Arizona and California are in a MEDICAL CRISIS!!! He does not know how much of the tax dollars go to supporting, birthing, caring, and educating these anchor babies. The tax payers foot the whole bill. And how do I know this.... it is because I am on the front lines of this everyday and so are my friends, we are all nurses and we care for these babies and mothers everyday we go to work. We do our best and give them the same services that everyone else recieves (rightly so, and I don't blame them for wanting better) but, it is killing the system. Mr. Lemons needs to do so honest research and ask any nurse on the front lines of Labor and Delivery and he might actuallly might find out for himself that the birthright citizenship is killing our country and dividing it racially. Oh, and by the why, I believe that we are the only country in the world that has "birthright citizenship". Really Mr. Lemons???????????

I have a hobby. Every Wednesday I drive around to the locations in my neighborhood that have New Times stands and I openly take the entire stack of freshly printed papers and pile them in my car. After a couple hours I usually gather about 500 papers or so (total guess on my part, I have never bothered to count). I then take them to the first dumpster I find and throw them in. I call it my personal BOYCOTT. I know it isn't much, but I take heart in the knowledge that I am doing my part to take down the mindless PC-propaganda machine that is called the New Times. If you are like me, and you are sick to death of the hateful extremist bullshit that is constantly streaming out of this paper I encourage you to do the same thing. Every time you see a New Times stand take all the papers in the stand and throw them away. Together we can force the editors of the New Times to go back to the good old "Entertainment" reporting they used to engage in. Otherwise we will simply bury them. Either way works for me.

Making children “illegal” does nothing to address the illegal/unauthorized status of the parents. It also does nothing to punish those adults, if you consider them to be the actual wrong-doers.

However, this scheme would potentially create a whole new, unique underclass of angry outcasts: people without citizenship whose country of birth does not recognize them.

This does not sound very civilized and certainly not like a very smart thing to do. So don't worry. It ain't gonna happen.

The 14 Amendment was written to make freed slaves legal citizens. That's what it's purpose was. The U.S. Consitiution is not written in stone. It can be changed and amended by the people. Anchor babies is not a misnomer you retard. If they can't deport a baby or child because of birthright laws then they can't morally deport the parents either. Having a U.S. citizen child does NOT protect the parent(s) from being deported. Thousands of parents are outside the United States from this reality. Until the child is 21, they cannot sponsor their parent(s) for immigration, and the parent has to be outside the United States long enough to satisfy the immigration bar (typically 10 years) against them.

If the parent has had other violations during the time they were illegally present in the United States their petitions can be rejected. That is the way the rules are written. I am a Conservative that has gone through the legal immigration process for my wife and stepchildren, so I do understand the rules and requirements.

And I am saying the term "Anchor Baby" is a misnomer. I haven't changed the subject, and I don't label people when I run out of arguments. You're going to need better facts to fight with.

Actually everyone within the boundaries of the United States have defined areas of the Constitution that apply to them. The sections saying "citizen" apply only to citizens. Most of the reason that the 14th Amendment (and it is more than just reinforcing "jus soli") was written was to prevent unjust removal of citizenship and someone's rights, against what you are proposing.

It is you that needs to study the Constitution more to understand it...

The 14th amendment was written to ensure the newly freed slaves would receive American citizenship and couldn't be labeled as Africans. It was also written at a time in history when we needed more citizens. Guess what? Population overload and changing times mean that it's time to take a look at some of the old laws. Should it still be illegal to have sex before marriage? Women couldn't vote at the time of the constitution or the 14th amendment. Most other countries, Canada, Europe, Australia etc. do NOT grant citizenship to anyone that is born there. It's time the U.S. did the same. NOT racist, just practical. Immigration should be granted to those who have something to add to society, not to suck away from it.

The 14th was written solely for the purpose to allow those freed slaves proper citizenship and to define citizenship for others as well. However if they had known at the time, that their wording left a huge loop hole which would be largely exploited, I highly doubt we would be having this discussion. Bottom line, there is a flaw in that amendment that is being exploited by all illegals, not just Hispanics. And the Pew Hispanic Center did specify, as it had a section for U.S. born parents or illegals. And while I haven't contacted another insurance company, I know that my insurance will not cover an illegal family member for fact.
