In the founder's historical documents and after the ratification, since it was written "for us and our posterity" it took either one or both parents to be natural or naturalized citizens in order for the children to be considered "natural or native born." And minors actually had no "citizenship rights" at all until they reached majority, and they intended that to be 25, if you read the Constitution, which is when they would most likely then be property or land holders. American children aren't truly "citizens" for Constitutional purposes insofar as crimes, punishment, or rights until they achieve adulthood. Period.

It doesn't have to be written, since the Constitution is a contract the "intent" of the provisions are to also be used when interpreting. Go to the National Archives. The "intent" of the 14th had to do with the 13th, and the slavery issue only. It was to redress what the founders had argued over insofar as slavery, and since most of the slaves were brought her unwillingly, it was to grant their children birthright citizenship as "foreigners" born here of captives. So please get a grip.

Obviously writer Lemons has no idea of the history of the 14th amend - it had nothing to do with illegal immigrants - it was passed/ratified because former slaves were being discriminated against by southern states after the civil war. Lemons interp is from a supreme court justice and is completely out of the context of the 14th amendment. How a legal citizen can be derived from illegal, undocumented people defies all logic.

I guess he has no idea of what he is talking about then. The state of Arizona and California are in a MEDICAL CRISIS!!! He does not know how much of the tax dollars go to supporting, birthing, caring, and educating these anchor babies. The tax payers foot the whole bill. And how do I know this.... it is because I am on the front lines of this everyday and so are my friends, we are all nurses and we care for these babies and mothers everyday we go to work. We do our best and give them the same services that everyone else recieves (rightly so, and I don't blame them for wanting better) but, it is killing the system. Mr. Lemons needs to do so honest research and ask any nurse on the front lines of Labor and Delivery and he might actuallly might find out for himself that the birthright citizenship is killing our country and dividing it racially. Oh, and by the why, I believe that we are the only country in the world that has "birthright citizenship". Really Mr. Lemons???????????

I have a hobby. Every Wednesday I drive around to the locations in my neighborhood that have New Times stands and I openly take the entire stack of freshly printed papers and pile them in my car. After a couple hours I usually gather about 500 papers or so (total guess on my part, I have never bothered to count). I then take them to the first dumpster I find and throw them in. I call it my personal BOYCOTT. I know it isn't much, but I take heart in the knowledge that I am doing my part to take down the mindless PC-propaganda machine that is called the New Times. If you are like me, and you are sick to death of the hateful extremist bullshit that is constantly streaming out of this paper I encourage you to do the same thing. Every time you see a New Times stand take all the papers in the stand and throw them away. Together we can force the editors of the New Times to go back to the good old "Entertainment" reporting they used to engage in. Otherwise we will simply bury them. Either way works for me.

Making children “illegal” does nothing to address the illegal/unauthorized status of the parents. It also does nothing to punish those adults, if you consider them to be the actual wrong-doers.
However, this scheme would potentially create a whole new, unique underclass of angry outcasts: people without citizenship whose country of birth does not recognize them.
This does not sound very civilized and certainly not like a very smart thing to do. So don't worry. It ain't gonna happen.

The 14 Amendment was written to make freed slaves legal citizens. That's what it's purpose was. The U.S. Consitiution is not written in stone. It can be changed and amended by the people. Having a U.S. citizen child does NOT protect the parent(s) from being deported. Thousands of parents are outside the United States from this reality. Until the child is 21, they cannot sponsor their parent(s) for immigration, and the parent has to be outside the United States long enough to satisfy the immigration bar (typically 10 years) against them.
If the parent has had other violations during the time they were illegally present in the United States their petitions can be rejected. That is the way the rules are written. I am a Conservative that has gone through the legal immigration process for my wife and stepchildren, so I do understand the rules and requirements.
And I am saying the term "Anchor Baby" is a misnomer. I haven't changed the subject, and I don't label people when I run out of arguments. You're going to need better facts to fight with.

Actually everyone within the boundaries of the United States have defined areas of the Constitution that apply to them. The sections saying "citizen" apply only to citizens. Most of the reason that the 14th Amendment (and it is more than just reinforcing "jus soli") was written was to prevent unjust removal of citizenship and someone's rights, against what you are proposing.
It is you that needs to study the Constitution more to understand it...

Wow! Last year a European lady on vacation had her baby and now it is a Canadian citizen. Ok, now multiply that by 12 million "vacationers". Oh yeah, and these vacationers don't go home. They stay and milk the system for all the healthcare, education, and other public programs they can. Oh sure they probable have jobs, but of those that do how many pay taxes. Lets face these aren't highly educated professional jumping the border, these people are unskilled and uneducated. I'm sure the tax system in Canada is fairly similiar to that of the United States, where low paid worked, especially those with children, pay no Income taxes. They actually get refunds of thousands of dollars if they do file their taxes. Then they take a percentage of their pay and send it to their home country. So lets add this up:
1: They are a drain on public programs such as health care, housing, education.
2: They don't pay income taxes, although i'm sure they pay sales tax. If they file taxes at all they recieve refundable tax credits amounting to thousands of dollars.
3. They send a percentage of their pay each month back to their home country to support their extended family- resulting in a net loss to the economy. Money sent to mexico from people in the US is the second largest contributor to Mexicos economy behind their oil fields. No wonder Mexico doesn't want to stop illegal immigration.
Something tells me Canada wouldn't be so welcoming if the country on their southern border was Mexico and not the United States.

The 14th amendment was written to ensure the newly freed slaves would receive American citizenship and couldn't be labeled as Africans. It was also written at a time in history when we needed more citizens. Guess what? Population overload and changing times mean that it's time to take a look at some of the old laws. Should it still be illegal to have sex before marriage? Women couldn't vote at the time of the constitution or the 14th amendment. Most other countries, Canada, Europe, Australia etc. do NOT grant citizenship to anyone that is born there. It's time the U.S. did the same. NOT racist, just practical. Immigration should be granted to those who have something to add to society, not to suck away from it.

The 14th was written solely for the purpose to allow those freed slaves proper citizenship and to define citizenship for others as well. However if they had known at the time, that their wording left a huge loop hole which would be largely exploited, I highly doubt we would be having this discussion. Bottom line, there is a flaw in that amendment that is being exploited by all illegals, not just Hispanics. And the Pew Hispanic Center did specify, as it had a section for U.S. born parents or illegals. And while I haven't contacted another insurance company, I know that my insurance will not cover an illegal family member for fact.

True or False - A family member can be on the health insurance no matter their immigration status.

First off, as a pregnant women, I personally find it irresponsible to cross a border close to term of pregnancy, as traveling distances can cause swelling and other issues, whether it be by car or plane. Oh and it puts in jeopardy the legal status of my unborn child. Second, the U.S. has policies already in place to protect it's citizens from such instances, so yes the child would become a citizen of the U.S. Third, would it upset you if I came to your country to have a child so that I could become further harder to remove from your nation, and asked you and your fellow taxpayers to foot the bill for the birth cost, as I didn't have the funds?

I find such idea to be downright preposterous.Why do the new born children have to pay for their parents' illegal problems?.I live here in Canada and according to the Canadian constitution all children born in Canada(even from illegal immigrants)are Canadian citizens.
Imagine for a moment if one of you,Americans cross over the border to visit Canada or to work here and you have a kid born here, wouldn't your kid born here be Canadian?.He wouldn't be American,obviously not.
Last year there was an European woman who was visiting Canada as a tourist and she was pregnant and gave birth to a child born in Canada.She later returned to her country but the child is a Canadian citizen and will be able to return to this country once he's turned to 18.
Imagine if Canada had a stupid law like non compassionate heartless Pearce is trying to get in the States then any pregnant woman who's a tourist visiting the States from other country and has a baby born in the States wouldn't be able to claim citizenship for that child.

If both parents are not legal citizens then the child is not either. If a child is born here and the partents are citizens of another nation then detain them until thier country pays the medical bills, not U.S. tax payers. The Constitutional Amendment was set up for legal families who have children to be guaranteed thier citizenship not a bunch of border jumping criminals. Just becouse you are born here doesnt make you a citizen. Your parents should be legal citizens before conceptionand not use anchor babies to obtain citizenship. Have you ever noticed that right-wing solutions to social problems usually involve punishment?
So, just how would this scheme work in actual practice?
To verify paternity, would DNA tests be required? Could someone challenge your citizenship 40 years later and claim that your grandparents had falsified their papers? If your parents became citizens subsequent to your birth, would you be deported anyway? Would you get a provisional birth certificate if your parents could not find their own papers? If you catch an illegally born person later (say he had been born at home), how would you know where to deport him to? How much would it cost to administer a national database and appeals processes?
Way too complicated. Not to mention unfair for punishing children for their parents offense.
And by the way, exactly what problem is this supposed to solve?

It's eating their souls and turning the USA into a Third World Nation. Never mind the Private Prison scandals where white murderers are easily allowed to escape to murder again. More security, more jails, more military and more laws is the sound screamed by the so-called small government GOP. The republicans created an economy based on war and security. It makes nothing, creates nothing and only costs us. We turn into a dependent State and Nation on the tit of an industry that cannot possibly pay for itself as it makes absolutely nothing of value. But when the Military industrial complex and Private Prison Industry becomes our number one employer and revenue (second only to Walmart where those employed spend there Gov. subsidized checks) we are obviously in trouble. It is evident you know nothing about the Constitution, try reading and then understanding the "Jurisdiction"clause. It clearly stipulates that the parents must far under the complete jurisdiction in order for their off spring to be considered citizens. Illegals immigrants dur to the fact they are here illegally are not, let me say that again, they are not under the jurisdiction of the United States. The confusion all stems from an incorrect Interpretation by some judge in the 1800's. And that lie has been perpetuated ever since. The concept of the 14th amendment, was never intended for rewarding citizenship to the offspring of illegals.

I'm a U.S. citizen that sponsored my wife and stepchildren to legally immigrate, so you can't lecture me on that. "Birthright Citizenship" had no effect on the time and money it took us to get here, and we understand the concept that citizens can get benefits before legal immigrants can. Your estimates and stories are wildly speculative, and don't fit with reality.
If you can't see the hate directed at you just because you are Hispanic, where it doesn't matter if you immigrated legally or illegally, then you need to look harder. You don't say if you are in Arizona or not, and specifically which country you immigrated from. All these Arizona bills that are coming from Russell Pearce are designed for one thing: To get Hispanics, whatever their immigration or citizenship status, out of Arizona.

well for some one that has had to deal with the whole legal aspect of coming to this country the right way and getting your resident card the leagal way(not fake) you might get a little angry when people breaking the law by coming here and having a baby gives you legal ground to get any type of assistance you want. Fine if you don't like the way of removing "citizenship" then they should have to apply...also on another note why is it that I work every day...have been since I was 15 and now when I was in need of government assistance I made too much money but if I lied and was here illeaglly but I had 10 kids here I could still live better than you or I. I could have a nice car,own the most expensive electronics with free medical to boot. you tell me WHY IS THAT??? not saying that all that come here illeaglly do this but I would say 85-95% do!!! Everyone can find a few people who parents were here illegally and whose children served this country. Anchor babies are another incentive for people to come here illegally. The child is due all services and they do take advantage of them. Yes the parents can be deported and then they give us the "Oh we cannot split up the family routine." In the majority of industrialized nations, citizenship is not a birthright. One parent must be a citizen for their children to be citizens. What everyone fails to see is that the pressure needs to be put on Mexico, Guatemala, Honduras, etc to provide jobs, education to their citizens. It is not the US's responsibility to take care of the people from other nations. In our country we have legal immigration. We should choose who comes into our country.
