Why wasn't the dress,outer shirt of his uniform tested? If he says he wasn't wearing it, or it was around his backpack, then he was out of uniform. How is anyone supposed to tell if a guy wearing a dirty, dark T-shirt is law enforcement. From a distance he would look like any civilian day tripper. And he says he didn't lawyer up. Either he or NT is wrong then. Did you see ole Louie at the news conference today? He was so indignant. Why won't everyone believe his story. Just because 6 smugglers carrying large bales of weed and AK 47's in the other arm just disappeared. A miracle! With all the law enforcement that was out there. 4 helicopters with infared up in the sky. To top it off all of this is occurring 80 miles from the border. Simply amazing. Just today we find out about the dirty cop in Phoenix who shot an unarmed man to death. You say so what? It happens everyday. This time a brother in blue who was also with him said he acted without a reason. And they only charge him with assault. Yeah, feel good tonight your cops are out there doing what they please!

First of all what was Puroll doing the entire morning besides eating his breakfast on the taxpayers dime? He's completely off anyones radar until he checks in the early afternoon? What kind of laxly run outfit is the Pinal County Sheriffs office? Why would any sane person who is planning to track and arrest smugglers sans backup support not wear his provided kevlar vest? One reason comes immediately to mind, it would certainly make self inflict grazing torso wound much more difficult. Would a sane person attempt any of this? And why is the green tee shirt not being tested? Can taxpayers trust these clowns to competently investigate anything?

Mr. Rubin, the test on Deputy Puroll’s shirt may result in an inconclusive opinion. There are several factors. The first factor is the muzzle was pointed not directly at the injury site. Therefore the cones of gaseous and unspent emissions (GSR) are not going to be the typical pattern found in a direct close contact wound. This GSR was blown away in the direction of the bullet and not the skin. This is ashamed, because the tee shirt and all his clothing should have been processed for evidence and forward to the lab immediately. The results are probable going to come back that there was GSR on the shirt; however, the amount present on the tee shirt is consistent with a person firing a weapon that was defending himself. I only say this because you did an outstanding job in your investigation and you should be recognized for your efforts. Babeu will use this example to get out of the mess.

CBS news just reported that on the day of the "shooting" they arrived to participate in the search for the supposed shooters. Sheriff Baboo actually asked them to help in the search. After 2 hours on the case he then told them that he wanted DPS to only process the the actual scene of the alleged shooting. Not to continue in the overall search. It gets curiouser and curiouser doesn't it folks. He called the DPS off the search of the "largest" manhunt in the state of AZ's. history. He must know he has carte blanc from on high to skunk up the investigation. Unless the FBI comes into the case and really does a professional investigation, this must be considered a coverup. People, if you know how to write a letter, please write to the FBI in this reagatd. There will be NO justice coming from any police organization in this state. C'mon people.

About a day ago, two suggestions (see previous email) for Sheriff Babeau to consider as possible policy changes within the sheriff department were made. This suggestion would eliminate the contact between deputies and individuals walking to Phoenix. By the withdrawing of all intervention by law enforcement, conflicts and disputes would not occur
The two policies would allow all desert hikers to arrive in Phoenix with their cargo unimpeded by local officers. It is imperative that we Arizonans maintain are welcoming behavior to our desert hikers. We don't need those pesky law enforcement officals attellmpting to detain or hinder them from joining our society.
Keep in mind that we should have no concern about individuals that choose to walk across the Pinal County desert in order to get to Phoenix. Our Federal government is protecting our southern border and would not allow any illegal activity.
Sounds like a goodand compassionate solution to this totally unsolvable dilemna.

Problem is the case is NOT being "reopened." Paul Rubin was just interviewed on NPR confirming this fact. Supposedly only the T shirt, not Puroll's outer shirt, said to be wrapped around his waist, was submitted for testing. A DPS sergeant interviewed on Channel 12 on Monday said all the person's garments who has suffered a gunshot wound are normally submitted for testing. Whatever can be ascertained concerning the holes in Puroll's shirts, won't hold a candle to all the other holes in Puroll's story....and there will be no investigation concerning those, just as there was not initially. DPS was told not to do an investigation into the actual shooting(s). So there wasn't a complete investigation before, and there won't be now.

Ronald, the New Times is not maligning or vilifying Puroll. Babeu is responsible for not having an complete and accurate investigation done by an uninvolved agency.
Since I am a retired law enforcement professional, and have been on both ends of shooting situations (shooter and investigator) I can tell you it's my personal opinion that Babeu has a whole lot to learn about professional policing.
If you want to be angry at someone about Puroll, put your anger where it belongs, squarely on Babeu.

Two policy changes for Sheriff Babeau to consider:
1. No Pinal County Deputy should detain or arrest any individuals carrying loads of dope across the desert towards Phoenix. It is forbidden to interfere with the abundant and prompt delivery of dope to Phoenix.
2. No Pinal County Search and Rescue Deputy should stop or assist any individual trekking through the hostile desert towards Phoenix. Even if the individual might be in dire physical condition, the Search and Rescue Deputy should not interfere with this individual's right to migrate to Phoenix.
Should these two policy changes be enacted by Sheriff Babeau, the added benefit would be to lessen the possiblity of racial profiling since the deputies would not be attempting to interact with individuals trekking across the desert in Pinal County.
Now, the Federal government has announced loudly, clearly, and repeatedly that only they are responsible for defending our international border. So, we Arizona citizens should feel secure that these problems have been and will continue to be handled efficiently.
Therefore, our local and state law enforcement officers would no longer be expected to address these issues. Surely, there are problems that are more important than preventing individuals taking a walk to Phoenix.

I lived in Queen Creek for over 15 years and assosiated with sheriffs of Pinal County. In thinking they were friends and knowing of many of their illegal and imoral scemes, Then one day they turned on me. I became the victim of a home invation set up by pinal officers. Four years later I still push for their arrest.. You see I have all the evidense to prove my case, but sheiffs dept. just keeps loosing it? Paul Babue knows all about it, but chose to ignore it after his election and after he gave me his word to handle it. Arpios boys also have a hand in some evidence I came across. Regardless Pinal County Sheriffs Department has more crooks working for them than than the prizon has inmates. From my owne eyes I have seen it and can back it up.

On April 30th, 2010 Pinal County Sheriff’s Deputy Louie Puroll was involved in a shooting with individuals in the Vekol Valley. This shooting drew both local and national attention.
The shooting was investigated by the Pinal County Sheriff’s Office and the Arizona Department of Public Safety. The criminal investigation had concluded and the facts of the case confirmed the accounts of the event as Deputy Puroll described.
Last week, the below two individuals reported to a Phoenix media outlet that they felt Deputy Puroll had been shot at a close distance (“within a couple of inches”) and not at a distance as the investigation has determined.
Doctor Michael Baden, co-director of the New York State Police Medicolegal Investigation Unit and former Chief Medical Examiner for New York City.
Doctor Werner Spitz, co-author of the textbook Medicolegal Investigation of Death and the retired Chief Medical Examiner of Detroit’s Wayne County.
Doctor Phil Keen, Maricopa County’s former Chief Medical Examiner, said that he did not agree with Dr. Baden or Dr. Spitz on their “contact wound” opinion. He stated he would need the results of the shirt being tested to confirm his opinion.
In an effort to maintain the transparency of our criminal investigation, we are reopening this case. The shirt Deputy Puroll was wearing on the day of the shooting will be sent to the Arizona Department of Safety for testing. The DPS Crime Laboratory has been asked to check the shirt for the presence of gun shot residue indicative of a close contact shot, charring, burning or any other evidence they can find of a close contact shot.

As a 25 year veteran of the U.S. Border Patrol, (retired) I had numerous encounters with drug mules traveling afoot through the desert. One thing they always leave is foot sign or tracks if you will. I have not heard any officiail of the Pinal Sheriff's Office states what the foot sign indicated. It alone would would tend to prove or debunk the deputies story. It seems the PCSO is purposefully avoiding any mention of this type evidence.

The unfortunate thing is that all this crap is working. At the end of the day, most Americans don't bother with details. They catch their "news" on the cable channels in soundbites that were written by the RNC, mixed in with the latest updates from Lindsay Lohan's jail cell. They don't care to learn the truth. What they want to hear is the "truth" that suits their political ideology.I want to know more about the backpack. Seriously, where was it? If he was holding a GPS in one hand and a BlackBerry in the other when he was assaulted, he couldn't have been holding the backpack too. He wasn't wearing it, there was no blood or damage from the bullet. So if he had just been chasing these smugglers and had his phone out in one hand (since he had been placing calls all afternoon) and the GPS unit in the other hand (he was giving dispatch and an off-duty supervisor his coordinates the entire time), when did he have the opportunity to take off his backpack at the very scene he was going to be assaulted? This story just doesn't add up. The fact that it took place less than a week after Brewer signed 1070 is fishy. Five to six AK-47 carrying drug smugglers hiking in the desert, surprising a lone deputy with a gunshot wound to his back from an automatic weapon (but no other wounds from automatic weapon gun spray)? And this whole "here are my coordinates in case I don't make it out," thing has got to be a joke. In law enforcement, if you feel your life is in danger, you do what you can to take yourself out of that situation. He could have backed away at any time and called for backup. But he didn't, he stayed there like GI Joe. The dispatcher was absolutely right, this guy was a fool. You're a Pinal County Deputy. You're not in Vietnam looking for Charlie. Even if he had busted up a pot smuggling ring, what the heck is he doing in the middle of nowhere with no backup and no protection? Babeu is running one hell of a department.

You are absolutely right about that. What also strikes me as odd is that the Flaccid Fool wanna-be, Sheriff Paul "Mr.Clean" Babeu, believes this corrupt deputy. I think you mentioned in a blog post that you believe the Flaccid Fool has had influence on Babeu. Now you have your answer.
Babeu stands by his deputy, despite more than 20 years in the Arizona Army National Guard. It seems to me that the hot barrel of Puroll's M-16 assault rifle, a weapon used by military members, caused the burn on Puroll's side, not being shot at.
PCSO is shaping up to turn into the next MCSO and Babeu is turning into the next MCSO shurf.
Sheriff Paul is mentally ill.

Old Timer, like you I am also from "The Days Gone By". However, I will disagree with you on there being probable cause. I think there is tons of reasonable suspicion to believe that Puroll may have fabricated this incident, but I think until a complete investigation is done there is always the possibility of exculpatory evidence in the form of the shirt. Conversely, the shirt could also provide the probable cause, as a form of 'smoking gun' in this case. But, I think the case right now falls short of of probable cause. Lots of unanswered questions and indirect evidence, however.

Why would any supervisor condone such action by a deputy?
Now, deputies are no longer allowed on solo patrol, "Babeu doesn't allow range deputies on solo patrols anymore".
Had that policy been in place there would have been at least one other witness to this incident, or more likely, the incident would never have happened unless there was a dual conspiracy to make it happen.
"He's out there stubborn as ever, doing his thing," Messing says of the deputy. "That's just Louie."
That statement, made by a sergeant, says tons to me. It means that the tail (Puroll) wags the dog (PCSO) and the sergeant is to blame. It also tells me why Puroll called this particular sergeant on his day off, instead of ANY on duty supervisor. Any competent on-duty patrol supervisor would have told Puroll to stop and wait for cover before proceeding, or to pull off the case all together.
In law enforcement there is ingrained into every officer one very clear intent: At the end of the shift you will go home safely.
Puroll seems to have started that day with a very clear plan to end the day with a helicopter trip to the hospital, and an aura of being a hero to his sheriff.
The 'investigation' I've seen so far would be considered incomplete and a huge joke by any professional law enforcement agency. Further, anytime it may appear that the credibility of the agency may be in question (as in this case) the agency normally hands the investigation off to another agency, and COOPERATES fully. Neither happened in this case.
Also, a normal Internal Investigation is controlled by the investigating agency, and since it's strictly a civil investigation between employer and employee, attorneys are NOT allowed to participate, much less dictate which questions might be asked and how the interview will be controlled.
PCSO strikes me as being either very naive or very dirty in this case. Politically, there is NO advantage for Babeu to find that Puroll fabricated this entire incident.
Just my opinion, based on twenty years of service as a professional law enforcement officer, two and one-half of which were experienced as an internal affairs investigator (Sergeant).
I can only hope Mr. Rubin and The New Times will continue to follow this story until PCSO is forced to cooperate in a complete investigation, by an unbiased agency.

The guy is a pscho wack job on a patrol power kick and is constantly harrassing individuals simply using State land for recreational purposes with a legal permit. You got to ask what kind of mentality is following 6 armed men in the desert by himself.???..This idiot has watched too many Rambo movies and is a large liability to the Pinal County Sheriff Department. Discharge this lunatic and let him give his long Bull S^&*t monologues at political pep rallys...make Arizona Deserts safer...I know i dont feel safe out there with this clown armed with an M-16 playing army man in combat fatigues!!

During the Great War, it would have been called a "blighty wound" - serious enough to get a soldier off the line but not serious enough to permanently incapacitate. In WWII it was called a "million dollar wound". This whole scenario stinks like an opened can of sardines. it would appear that deputy Puroll or a confederate shot him and then claimed he was shot by "them" - the smugglers. That's a self-inflicted wound, thought of as an act of cowardice in the armed forces. If Puroll feels he was wronged or libeled by this article, let him seek legal redress in a court of law, where he can make his case and ask for damages. Or he could take the moral high ground and demand a polygraph test. My guess is that he will do neither - because he is a liar and a bullshitter who is seeking attention and approval from a boss who is self-serving, egotistical and morally pliable.

First of all, Mr. Rubin, thank you for an excellent and timely story. If this is an example of the way that Babeu handles investigations of fellow officers, how can we expect a sober and serious investigation of Deputy Munnell's complaints against top MCSO officials?
The most puzzling aspects of the story, which involve Puroll's wound, aren't mentioned in the story, however.
First, there is the "tail" which begins at the rear of the horizontal bullet graze and curves up and to the left. It's clearly a burn (note the puckering of the blistered skin) but doesn't follow the trajectory of the bullet and has too much changing curvature over its inch or so of length to represent to path of a bullet. It could be the hot tip of a rifle or pistol muzzle as it was pulled away and/or as the body jerked away from it.
Also puzzling is the very straight, white line that bisects the reddish patch of skin around the wound (the contrast of colors almost making it look like a scar).
Also problematic is the blackened (burned or sooted) area of skin above the bisecting white line. The bullet clearly did not come into contact at that point (the wound is considerably lower, underneath the bisecting white line), so why is the skin there blackened at that point?
Another aspect of this mystery -- somewhat less clear to me than the above -- is what appear to be several small patches of t-shirt cut away around the border of the bloodstain. Look closely at the photo and you can see the darker (less sun-faded) teal-colored patches of fabric which appear to be the interior of the facing side showing through. Admittedly, this interpretation is challenged by what appear to be rather similar, and quite thin, extrusions well above the wound area. Nevertheless, two of these patches seem to correspond to both the "tail" (blister arc) and the blackened area above the bullet graze.
The question might be asked, who removed these t-shirt patches -- assuming that I've correctly characterized them as removals -- and when? Emergency medical personnel treating the wound might have done so, except that were it necessary (say, because the fabric was imbedded in the wound) one would not expect so much precision: after all, the t-shirt was already ruined anyway; and in any case the snipped portions (if that's what they are) are outside the wound area on the border of the bloodstain. Has anyone interviewed EMTs or hospital emergency room staff? (No doubt privacy issues could make this difficult.)
