Retired Justice Sandra Day O'Connor was dissed by Russell Pearce over Prop 200's dismissal.

In late October, days before the election, state Senator Russell Pearce directed his e-mail wrath at retired U.S. Supreme Court Justice Sandra Day O'Connor, whom he decried as an "activist judge" with a "lack of trust and respect for 'we the people.'"

Russell Pearce contended that Sandra Day O'Connor should be charged with ethics violations.

The reason: O'Connor, who occasionally serves as a stand-in federal judge, was one of two judges in a three-judge Ninth Circuit Court of Appeals Panel who, on October 26, voted to strike down a key provision in Pearce's beloved Prop 200, which required Arizona residents to produce "proof of citizenship" to register to vote. (Federal law asks only that potential voters sign a registration form and attest to their citizenship under penalty of perjury.)

O'Connor ruled that the heart of Prop 200 violated the National Voter Registration Act because parts of it were an obstacle to the user-friendly, widely available voter registration required by the act.

Voters approved Prop 200 in 2004 because Pearce and others had them believing undocumented immigrants could steal elections, even though election officials had found no evidence of stolen elections.

Pearce's proposition was a thinly disguised effort to give Arizona's white voters an electoral advantage and to keep Mexican-American citizens from voting, critics said.

"So what is the message from these judges?" Pearce huffed in his e-mail. "If an illegal alien is trying to register to vote, it is okay to ask them if they are a citizen, just don't make them prove it? You have got to be kidding!"

Prop 200 was backed by then-Secretary of State Jan Brewer, Pearce, and the right-wing nonprofit FAIR, which reportedly kicked in $400,000 to help gather signatures.

Virginia Abernethy, a self-described "European American separatist," spearheaded Arizona's Prop 200 drive as chairwoman of its national advisory board.

Although Abernethy's worldview and white-nationalist ties were no secret — her writings had been widely published — FAIR didn't find her views "repugnant" until it asked her to resign from the board in August, three months before the election.


Of course, if you check Tanton Network Web sites, almost all of them decry illegal-alien voter fraud. This ties into the position of Kansas Secretary of State Kris Kobach, the SB 1070 author who worked for FAIR's legal arm and got elected, in part, by scaring Kansas voters into believing undocumented immigrants were voting in state elections.

It also links to Russell Pearce.

In the week leading up to the 2010 midterm election, Pearce and groups affiliated with him sent out frantic e-mails asserting that illegals were poised to steal Arizona's elections.

The e-mails warned of possible widespread voter fraud to mobilize the voter base. The Mexicans were signing up "illegal's [sic] and dead people to vote for the socialist, anti-American agenda incumbents," one e-mail said.

Ban Amnesty Now, which is closely affiliated with Pearce, echoed the claim. A November 1 e-mail from a group called Common Sense warned of widespread voter fraud, including "registering felons and illegals," in Yuma.

Reacting to the vitriolic e-mails, the U.S. Attorney's Office in Phoenix announced that FBI agents would handle "allegations of election fraud and other election abuses" on Election Day.

Republican Arizona Secretary of State Ken Bennett, in an October 27 press release, said the e-mailed rumors of voter fraud were false.

Retired Justice O'Connor, who never discusses her judicial decisions, was not charged with ethics violations for ruling against "we the people" by striking down parts of the white-nationalist-backed Prop 200.

And Russell Pearce, the guy who called the first woman to serve on the U.S. Supreme Court an "activist judge" and railed for an investigation into her judicial conduct, is now president of the Arizona Senate.

Please explain why a "Mexican-American" can not provide proof of citizenship and why proof of citizenship means "Mexican-Americans" can not vote?

The issue at question is whether only citzens of the United States should be allowed to vote in the United States. In any other country, this point is clear. In several local elections in various districts around the country, it is now legal for non-citizens to vote, At what point will this end?

In all due respect to everyone, I hope we can work together as a nation to enact comprehensive immigration reform. Mr. Tanton and his 20-some sister groups including FAIR, Numbers USA, Center for Immigration Studies (CIS), are using a small group of intelligent people, an astute use of the internet, and wealth to detract us ordinary citizens from very possible peaceful solutions. They do this by using strong words and false facts to fan the flames of a sad immigration debate.

For example, two years ago, John Tanton's FAIR brought broadcasters to Iowa radio to broadcast numeric facts about immigrants and our economy. The numbers they broadcast were quoted from Numbers USA

However, they were way off from statistics done by Iowans in a study at the Iowa Policy Project in Iowa City. The study was paid for and carefully followed by over 3000 Iowans. Studies done at three major Iowa universities were in line with each other and the Iowa Policy Project study.

So when FAIR presented their "facts" to Iowa, they were called on it, but they continue their disruptive methods. This distracts us from what needs to be done. It distracts us from going after real criminals (drug and human traffic dealers) and from passing immigration laws that make more sense.

I am so sick and tired of the hate spewing, fear mongoring and self-serving righteousness that permeates our political state of affairs, not only in Arizona but in the nation in general. Since the 2008 elections, there has been a definitive shift in political dialogue, one that is focused on unity, patriotism, and ethnicity (commonly but incorrectly referred to as racism).

Politicians, such as Pearce. Brewer. Sarah Palin, speak of unity, but their actions are divisive. Their rhetoric spouts patriotism, yet their actions deny the very essence of those American ideals they say they are upholding. Their efforts claim to be for every true American regardless of one's skin color, yet their actions are cloaked in an extremist worldview which has no tolerance for diversity of any kind, not in thought, belief or being. Politicians such as Pearce, Brewer, Palin, political activist such as Karl Rove, and political pundits such as Beck, Limbaugh, and Hannity, they are the ones who are anti-America, unpatriotic and the true terrorists destroying this great nation of ours.

True voter fraud is being conducted by political action committees, such as American Crossroads and Citizens United, whose blatant voter manipulation is hidden by the veil of a Supreme Court ruling which denies transparency in elections. The machinations of American Crossroads and Citizens United are far more reaching and damaging to our voting process, and to the fabric of our nation, than the numbers of individuals who commit voter fraud.

I agree that fraud is fraud, and two wrongs don't make one right. The main idea in this article is that the state of Arizona is overtaken by groups of proven Nazis who are using our democratic process to advance their hate agenda. They continue to lie and use people of Mexican ancestry as scapegoats. The reason why Mexican Americans, Chicanos, Hispanics, and Latinos are standing shoulder to shoulder with our undocumented brothers and sisters is because the derogatory term used for them is a code word for all of us.Pearse, Arpaio, and their like are criminals who are using our economic crisis and undocumented workers as a tool to attract gullible Caucasians to the ranks of white supremacist groups.Now, name calling, such as Liberals or right wing nuts does not solve a thing. There has to be rational dialogue. We are living a new age when lies are posted in line and then get resposted, and reposted again and then become truth. We have the first amendment that protects everyone's freedom of speech. Most of the better known conservative political entertainers are known to repeat lies and half truths.

There's a question that people have either skirted around or not been able to answer for me maybe you can help. It's more in line with this article. In what country, other than the US, can someone from another county vote in a Primary or General election?

I have worked in the Maricopa County Elections Department and know the procedures which prevent anyone from voting that is not eligible. They are solid and there are virtually NO incidences of anyone who is not eligible to vote having their votes counted. A cow may vote but the County Elections department must match that cow's elibibility status and they'll catch the ineligible vote and throw it out.

Yes Walter you are correct. And once again just to clarify the issue, when someone fills out a voter registration card and signs their name, that is a legal affidavit. On that document it states "Are you a citizen of the United States of America?". Just to the right of that statement it says "If you check 'NO' to either of these questions, do not submit this form." The other question is "Will you be 18 years of age on or before election day?"

If you lie on the form you will be committing perjury. Now after thinking about it for a few days, lets say voter registration goes up 150k between now and the next Primary. If the before that point, Ken Bennett wins his appeal, all 150k will be verified. Best possible case, all registrations are tossed. Worst possible, I.C.E. has a list of address.

Prop 200 was shot down by Federal Judges. Ken Bennet is fighting their decision BUT as of today the County and State can not verify Citizenship when registering to vote. It is a crime punishable with a charge of perjury to register and not be a citizen. What can be done? Anyone can challenge someones right to vote by simply saying I don't think you are eligible to vote. The Democratic National Committee can as for a list of registered voters (they don't get all their information) in Arizona and run their own audit.

If you do, in fact, work for the Maricopa County Elections department, you would know this.

The National Voter registration Act of 1993 states that anyone who renews their motor vehicle license by internet can also register to vote. You need to be a citizen to get a driver's license. Hence forth you can also register to vote regardless if you are a citizen or not. All you have to be is resident in the United States. And you don't have to be a citizen to be a resident. You should take care when you call someone a liar. You know jack.
