Attorney General Horne Hired Carmen Chenal to a Highly Paid Top Post -- 'Cause She's His Goomba

If you needed the services of a criminal attorney, would you hire a lawyer with no experience in criminal law, who had been suspended from the State Bar of Arizona for 120 days, had not practiced law in five years, and who was still on probation for her past misdeeds?

Add to this a DUI charge pleaded down to reckless driving, a bankruptcy, and a history of mental and physical issues that may or may not have caused the misconduct that led to the lawyer's suspension.

With that sort of record, I think most folks would pass, as there are a lot of lawyers in the sea with more of the right kind of experience and lacking black marks on their careers.

Not Arizona Attorney General Tom Horne, who has hired his longtime political crony Carmen Chenal as an assistant attorney general in charge of foreign extraditions at a salary of $108,000 a year.

Chenal's expertise is in construction and real estate law, and she briefly was a partner with Horne in his firm before Horne became Arizona's Superintendent of Public Instruction in 2003.

In 2006, Horne hired his buddy at the Department of Education as a program specialist in special education, at a $62,947 salary, even though she had no experience in the field.

But lack of experience was the least of Chenal's problems. Just a year earlier, the Bar had suspended her law license for four months and ordered her to pay $2,500 in restitution to one of her victims, as well as foot the $1,018 bill for the Bar's investigation. She also was placed on probation for two years.

The allegations against Chenal were substantial. In one case, Chenal took part of a client's settlement money and applied it to his bill in another case without his permission.

In that second matter, Chenal's suit on behalf of her client was thrown out of court, with attorney fees in the amount of $17,037 awarded to the defendant. Chenal's client wanted her to appeal the decision, but she failed to do so. The client was so ticked off that he fired her.

In another matter, Chenal took on a domestic-relations case in Illinois. One little problem: She was not licensed to practice in Illinois. The Arizona Supreme Court hearing officer's report on Chenal's suspension noted her "unauthorized practice of law" as her "most serious violation."

But there's much more.

From 2001 to 2003, she bounced three checks for filing fees to the Clerk of the Maricopa County Superior Court.

In a medical-malpractice case, she sent a letter from one of her expert witnesses to opposing counsel, after she allegedly had "whited out" corrections the expert had made in the margins. Like bouncing checks to the clerk of court, altering such documents is a no-no.

A summary of her disciplinary history on the state Bar's website notes Chenal's bumbling in another case.

"Ms. Chenal listed a party but did not provide any allegations against the person in the civil complaint; presented claims barred by the statute of limitations; and after listing many witnesses on the disclosure statement, only one testified, and the testimony was inconsistent with that listed on the disclosure statement."

Despite the details of her suspension, Horne defended employing Chenal at the Department of Education to New Times in a 2006 article ("Changing the Chenal," April 27), describing her as a "first-rate lawyer" undone by various family issues.

"I think we're lucky to get her," he said at the time.

Interestingly, Chenal also declared bankruptcy in 2004, forcing her to sell her car to pay her debts. That might have been for the best, since she'd been charged with a DUI in 2001, which according to the record on file with the Dreamy Draw Justice Court, she pleaded down to a reckless-driving charge.

In 2002, Chenal was charged with driving on a suspended license in Carefree Municipal Court. The case was dismissed.

Of course, Horne has had his own problems, albeit in the more distant past. In 1970, his investment firm T.C. Horne & Co. went belly-up, resulting in a lifetime trading ban with the Securities and Exchange Commission. A fact he failed to disclose in his law firm's annual reports to the Arizona Corporation Commission.

So maybe Horne has a soft heart for fellow lawyers who've messed up heretofore, like Chenal. And it probably didn't hurt that Chenal has been a stalwart campaign operative for Republican Horne in more than one race.

In any case, Chenal waited five years to apply to the Bar for reinstatement.

Because she'd waited so long, she had to go through a formal reinstatement process, with evidence, witnesses, and a hearing, at which her counsel argued that Chenal should be readmitted without having to participate in the Bar's Member Assistance Program, part of the probation process in which a delinquent lawyer receives counseling and is monitored closely.

Essentially, Chenal wanted to be readmitted without doing the two years' probation she had agreed to in 2005. But the hearing revealed the extent of Chenal's past mental problems.

Chenal, her lawyer, and her doctors argued that her life spiraled out of control from 1999 to 2003. In 1999, she divorced her spouse of many years, Tom Chenal, who, oddly, is employed by Horne as the chief counsel of the AG's public advocacy division.

Charlie Oscar forgot to mention in the post bellow that extraditions are just a small part of this position's work load. The salary for the position was not set by Tom Horne when he became AG, but was inherited from Goddard's schedule of ranges of salaries. The range remains same and Ms. Chenal's salary is in the exact middle of that range. Apart from extraditions, this position requires to handle multiple criminal cases and host of other responsibilities. It is also driven by the court deadlines and, therefore, requires to put in much more than the regular 5 day/40hr week that most of us work. The suggestion that "the 2nd year data specialist could handle same work at $38K per year" is a good one, except that, considering how many extra unpaid hours Ms. Chenal clocks-in, or should I say does not "clock-in", we taxpayers pay much less than we would pay for the “2nd year specialist” (even without any benefits). For the quarter of the specialist's pay we get a full expertise of an experienced attorney. Seems like a good deal for Arizona taxpayers! Speaking of an experienced attorney brings me to my second point. It is ironic that supporters of Felicia Rotellini are attacking Ms. Chenal and are so concerned with her experience. Ms. Rotellini claimed to be an experienced prosecutor based on only two jury trials as lead lawyer. Both of them personal injury cases :( Hence the nickname 'Two Trial Felicia'. Ms. Chenal has much more jury trial experience and is being attacked for holding a much lower job (something that 2nd year specialist could handle, according to some) than the one Ms. Rotellini ran for. Well, Ms. Chenal had her problems ten years ago. Didn't you have problems in your life? Didn't we all? One who never screwed up, "let him first cast a stone at her." To err seems to be one of those universal conditions which no one who did anything worthwhile, or anything at all escapes. All of us had problems and messed up more than once, if we are honest. Ms. Chenal's extensive trial experience and her dedication and hard work makes her eminently qualified for the job. The kind of vicious piling on on a relatively low level employee (working hard in a dangerous job) by Rotellini supporters does not reflect badly on Ms. Chenal. It reflects very badly on them!

New Times should check on just how many of these extraditions occur in a single year...Not to mention the US State Dept. handles foreign requests for extradition. If it involves a US citizen, it's about as easy as faxing a warrant to the particular country's federal prosecutor. If it involves a Mexican in Mexico for example, it's more complicated and I would bet Ms. Chenal does little more than act as a liaison with the State Dept...something an 2nd year data specialist could handle at $38k per year. This is just another example of the arrogance of civil service and the mentality of: "trust me, I know what's best for the people” And, "how dare you question my authority".

I work with Carmen Chenal. She is one of the most dedicated, bright, and hardworking attorneys in the AG's Office. "Per Carmen Chenal's Request" should get her/his facts straight before spouting off completely FALSE statements! There is and never was a "list of all applicants" for the extraditions "position", because there was no position to be filled! Ms. Chenal volunteered to assume the added responsibilities of extraditions IN ADDITION TO her heavy caseload and the strategic planning she completed for over 50 departments in the Attorney General's Office! The job of extraditions is not a position that Ms. Chenal took away from a more qualified applicant. Ms. Chenal has not been paid a penny more for the added responsibilities she has taken upon herself for the good of the citizens of the State of Arizona. Next time you engage in a smear campaign, at least get your facts straight first!!

Because the experts mentioned above have all insists that Carmen is perfectly capable of practicing law and doing an excellent job at it. The author decided not to quote from them because he is not interested in presenting an objective picture of who really Carmen Chenal is. Instead he presents invectives designed to prejudice an uninformed reader. Plenty of those out there, no doubt. Such sophistry, however, is double-edged: the suppressing of the facts allows him rhetorical victory at the cost of truth. Please don’t get mislead by unscrupulous ideologists. You can file a public records request and get a list of all applicants that applied for the position and find out rather or not she was truly the best qualified applicant for the position.

On a Side Note: I hope the country she will be going before to obtain extradition do not check the Bar Website. :-)

I'm appauled, but not surprised. That's the standard slop that passes as reporting these days - sensationalism, hype and slant....and almost always a liberal slant. What ever happened to "just the facts." Lemmon picking and choosing only what he thinks paints a negative picture or makes a reader skeptical is clearly an creative pot-shot at Horne, who he clearly did not favor.

I, on the other hand, believe Horne was right. Chenal is hard working, and is currently doing a stellar job. Moreover, in order to make it past her trouble spot, she had to prove herself above and beyond that which any other attorney has had to do, and thus, is more reliably competent than other attornies. No perfect person applied for the job. No such person exists on this Earth (anymore). It is illegal under the civil rights law to base hiring decisions on solely the BEST qualified person for the job; all qualified persons must be considered equally for the position. The issue is not BEST qualified, the issue is qualified or not. And how would anyone but the AG hiring people know that? The sole basis for a disappointed applicant for the job to sue would be based upon discrimination against a protected class. Since Ms. Chenal is a twofer protected-class wise (female & Hispanic), how would that case be made? And to believe you critics, she also has a qualifying disability for which she is entitled to accommodation, thus a three-fer. Got a disappointed applicant who can match those qualifications?

Okay, so what we will all do is send all the information to Lemon and have him write the article that personally attacks Carmen Chenal. It would have been wiser for Ms. Chenal to just stay silent as opposed to going on the defense my personal guess is she plays a horrible inside game.

Random rants will not make this situation go away for Ms. Chenal. The problem is that she has upset many people and they have a grievance with her that they are placing in the open in order to not be retaliated against. So Ms. Chenal, you need to know that the problem is not going to go away anytime soon but only get worse. My guess is that on Monday morning you will get into the office later than normal because you will be medicating yourself more than normal because of this situation.

Understudy? This is not acting; practicing law is just an expression, it doesn’t mean preparing to do it, it means doing it. Ms. Chenal’s qualifications meet or exceed those of her predecessors in that position. There is absolutely no reason to believe that Ms. Chenal will not do the job as well as they did (unless you’re a sexist racist who believes that a female Hispanic is unqualified). The author did not allege girlfriend of AG Horne; just woman & friend. Do you have any friends w/ whom you’re not sleeping? To allege more than friendship just because of the opposite sex is homophobic; you for example may well be having sex w/ a same sex friend. Not that there’s anything wrong w/ that.

Ms. Chenal was highly recommended by prominent lawyers & Judges, & received the highest ratings in her first Attorney General assignment. The State Bar determined that there is absolutely no reason she should be limited in her practice of law. Give the lady a chance, just like the law firm did that hired Felecia Rotellini to be a bank lobbyist after she failed to prevent the biggest bank frauds in AZ history. Where is the NT’s expose of the incompetence of Felecia Rotellini? Oh yea, Felecia Rotellini must be the Goombah of every NT writer, not to mention Janet Napolitano’s Goombah, which must be why she appointed her as banking chief despite her lack of qualifications for the job. I believe that Carmen is a very well Educated and Great Attorney for the position. We have to remember here, Carmen is an exceptional human being and is very qualified for the position. I personally think the new times should be more selective who they hire, because this Mr. lemons is really a shady character. Tom Horne is the BEST ATTORNEY GENERAL, brilliant and a wonderful person. How could you possibly know that the post came from Ms Chenal’s personal email address? New Times does not divulge that info. Or do they? Will NT tell me who you are? Are you the author? His Goombah? Another NT employee? What is this, another Rupert Murdoch-type hacking scandal? Has it ever occurred to you that email can be sent from your email address w/out it being from you?
