Joe kvetches: "A federal judge recently ruled my office engaged in 'racial profiling,'" as the result of a lawsuit "filed by open-borders activists led by the ultra-liberal ACLU."
Arpaio states in the letter that he disagrees with Snow's ruling, but he will "abide by the decision until it is reversed by a higher court."
But that's merely an aside, allowing Arpaio some wiggle room if he's called on the remainder of the letter, in which he's defiant.
"Ultimately, they want to have a 'federal monitor' in my office looking over my shoulder, making everything I do politically correct," Arpaio snarls at one point. "I was elected by the people, and I won't stand for it."
Well, if Snow appoints a monitor for the MCSO to be the judge's eyes and ears in the case, as he's already said he's inclined to do, Arpaio certainly will stand for it. He doesn't have much choice. He lost, remember?
"I will never back down — not even one inch — when it comes to doing the job I was elected to do," Arpaio says at another point in the letter.
Arpaio's slippery language aside, does this sound like a guy who will voluntarily comply with Snow's orders without being forced to?
Perhaps, as he did with own co-authored Joe's Law, the sheriff will deny ever having read the letter. No doubt Willems handles such matters for him, just as Arpaio conveniently delegates authority to his flunkies, so he retains deniability.
I can only hope Snow is as impatient with Arpaio's excuses and games as a lot of us are.
Both Casey and Arpaio's friends in the media are squirming, arguing that because Arpaio is an elected official, Snow cannot or should not appoint a monitor.
But elected officials have to accept monitors in civil rights cases all the time, and these officials often bitch and moan about it, whether it's Mayor Michael Bloomberg in New York, apoplectic over a judge reining in the New York Police Department's stop-and-frisk policy, or Mayor Mitch Landrieu of New Orleans, outraged at the more than $8 million a court-appointed monitor for his city's police department will cost.
Like it or not, elected officials must obey the U.S. Constitution, from the president on down.
And if a majority of locals agrees with an elected official's unconstitutional practice, that's not a free pass. Rather it's an indicator that the electorate needs a remedial class in civics — which Snow should give Maricopa County very soon.

The lawsuit has already stopped the sweeps permanently. Thats a fact and a matter of public record. That was an order Judge Snow had already ruled on in 2011 and now it is a permenent order.
It will not change the sick and twisted work-site raids because the lawsuit started before they did. But stay tuned. This is just the beginning.

@Bnbk in my opinion all a monitor will accomplish is to verify Joe's non-compliance. i am still all for a monitor, because then we will have someone who's job it is to record his non-compliance for further legal action, but it wont make him suddenly comply. i think it will make him do the complete opposite, he will try to buck against the system even harder which will eventually damage him further (and hopefully get someone to actually step in and take action)

@danzigsdaddy reasonable suspicion is necessary for every traffic stop. Telling the driver why they were pulled over prior to asking for thier information is merely a formality as it's normal to tell them why they were stopped.
YPS is not only part of that agency, YPS is part of the problem.
From his/her/it's comments and attitudes, it's clear that, assuming YPS is a patrol officer like claimed in the past, they are one of the patrol officers who does exactly the type of profiling and civil rights abuses that MCSO is now getting slapped for.
There is no way possible that anyone could defend MCSO to the extent that YPS does, without being one of the guilty parties and even worse, knowing what they are doing is wrong and just not caring since they think the party will never stop, thanks to Joe Arpaio protecting them.

The first thing one learns when training or practising legal observing is that cops (like most criminals) generally behave better when they know they are being filmed. It automatically stops lots of bad policing, racial profiling and abuse of power.
It stops lots of abuse from ever happening. It has always been the number one reason I encourage everyone to always film the police.
Thats what filming police accomplishes and it doesn't matter if its legal observers with cameras or police being forced to film themselves.
It's also clear in many examples where Phoenix PD, MCSO, DPS have shot and killed unarmed people and gotten away with it that those stops or interactions were not filmed and the only witness's are the cops that have no respect for human life or the truth.
Thats why PLEA is opposing cameras for Phoenix PD. MCSO has fuaght with, threatened and harrassed legal observers at all but the last few sweeps stopped by this order. That is a well documented fact.
YPS, MCSO needs to repair its image and its standing within Maricopa County. I fully believe that the monitor will help do that.
MCSO needs to show through its actions that it is a credible and professional police agency. Doing shit like ignoring sex crimes against children and rounding up only Hispanics during raids are the reason why a monitor is even being appointed.
Joe has a chance to save face and work with the monitor to repair and improve his relationship with the community. As the duly elected sheriff, he is ultimately responsible for his agency's actions. If he hopes to win another election (assuming he's running again) he needs to utilize this opportunity to fix what's wrong with his agency.

It was a victory for the plaintiffs and a colossal failure for MCSO and the racist way its been conducting itself over the years.
Some things already changed because of it and more will. by order of federal judge is on its way. Either way, that monitor will be part of MCSO for the next several years, with or without Arpaio's blessing or re-election.
