Fourteenth Amendment Challenged by Racist Wackjobs in D.C.

Pity poor state Senate President-elect Russell Pearce.
He couldn't be there for all the fun today in D.C. as a passel of his moonhowlin' racist buds -- including nativist poster-boy Kris Kobach, now Secretary of State from Kansas, Pearce's primary flunky Arizona Representative John Kavanagh, and fellow Sand Land wingnut state Senator Ron Gould -- unveiled an illegal, un-American plot to undo birthright citizenship as enshrined in the 14th Amendment to the U.S. Constitution.
Their genius plan? A two-tiered system of birth certificates: One for the undocumented, and one for everyone else. Sheesh, they might've well sought one for white folks and one for brown folks.
There's another nutty notion in the mix to deny "state citizenship" to those born of undocumented parents. State citizenship, huh? Maybe we should just go back and fight the Civil War all over again. I don't know about y'all, but I'm wearing Union blue.
Here's the problem with states making their own laws when it comes to citizenship: It's unconstitutional.
In addition to its birthright provision, the 14th Amendment specifically states,
"No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws."
So what these dunderheads are proposing is essentially illegal under the U.S. Constitution.
The Washington Post has a pretty good explanation of Kobach's proposals, here. Kobach, you'll recall, is one the attorneys for the Federation for American Immigration Reform's legal arm, which helped draft SB 1070, Arizona's breathing-while-brown law.
I was glad to see that the event was disrupted. ABC has posted some video (above) of activists engaged in civil disobedience, standing and objecting to the proposals until they were forcibly removed.
Bully for them. There needs to be more strident-yet-peaceful actions such as this, so that this un-American push by the nativists remains the province of lunatics and bigots. People have to be willing to be arrested and willing to raise some heck.
