Russell Pearce's Bro Lester Pearce Faces Ethics Charges

I've rarely read a legal document so delightful.

The one I've just received from the Arizona Commission on Judicial Conduct indicates that Lester Pearce, former Justice of the Peace and brother of recalled ex-state Senate President Russell Pearce, now faces various charges of ethical violations, in part, because he stumped for his brother at a meeting of the former Legislative District 19 GOP.

Allow me to direct your attention to page three of the statement of charges, where it reads, "Media coverage on October 14, 2011, called Respondent's conduct into question, noting possible ethical violations."

As you can see from my blog dated the same day, I was the first to report that Judge Pearce had stepped over an ethical line at the September 15, LD 19 meeting in question.

 

On November 1, 2011, days before the recall vote, I followed up with a blog post that published the minutes from that meeting, which noted that Lester "spoke in support of Senator Russell Pearce and against the recall."

(Note: Nine days later, the LD19 board "corrected" the minutes over the objection of the chair to read that, "Lester Pearce spoke about the Constitution and the role of judges.")

Additionally, the erstwhile jurist is alleged to have accompanied one of his nieces as she collected signatures on behalf of sham recall candidate Olivia Cortes.

Last year, before the historic debate between Russell Pearce and the ultimate victor in the race, now state Senator Jerry Lewis, videogapher Dennis Gilman and I confronted Judge Pearce about some of the allegations swirling about him.

He became so enraged, he advanced on Gilman and grabbed his camera.

The tables, they have turned and currently are waterlogged beneath an ocean of irony.

As the press release accompanying the charges states, this judge who fancies himself a constitutional scholar of sorts, stands accused of, "violating Article 6.1, Section 4, of the Arizona Constitution which prohibits a judge from engaging in `conduct prejudicial to the administration of justice that brings the judicial office into disrepute.'"

My good friend and election law expert Tom Ryan, who was largely responsible for exposing the Cortes sham-ocracy in court, offered the following observation after I spoke with him today.

"It's hard to find this quality of humor at such low prices."

Know what's even funnier? Lester is fighting the charges. A hearing is scheduled for December 21, according to Arizona Supreme Court spokeswoman Jennifer Liewer.

Bring your popcorn, kiddies. Who knows, we may finally get to the bottom of the Cortes bog, after all.

Lester could be censured and fined court costs, if he's found guilty. In the past, I was told that barring him from running again was a possibility, but that's not mentioned in the information provided by the commission.

As "the Great One" Jackie Gleason liked to say, "Mmmm, how sweet it is!"
