The blues rock duo has filed two lawsuits against Della Femina Rothschild Jeary and Partners for using The Black Keys' song "Tighten Up" in a television commercial for New Jersey's Valley National Bank without asking permission from the band's record label, Nonesuch Records. The label has asked the advertising agency to quit airing the ad.
The label reportedly sent out cease-and-desist letters, but both the ad agency and the bank ignored them. Nonesuch is asking judges to award damages according to how popular the song is
. Considering the Black Keys won two Grammys right after the ad launched and the song has since gained popularity, they could be awarded a hefty amount of money. It seems like Della Femina should prepare to "tighten up" its bank account.
