Get Out!: Arizona and America Join Joe Arpaio in Rushing to Inquire: Are Your Papers in Order?

Unable to regulate our border, unwilling to create a reasonable path to citizenship for the immigrants who labor in our place, Arizona law enforcement officially now undertakes to rid us of Mexicans.

Because of infamous Arizona Senate Bill 1070, which is to take effect on Thursday, July 29, the pretext of traffic stops will now initiate a search for residency papers, a practice at once abhorrent and also under consideration by as many as 20 other states.

The national terror of reconquista will now flood the streets and courts of Arizona.

The ACLU and the United States Justice Department are seeking an injunction to put SB 1070 on hold until seven lawsuits pending against it can be addressed.

While lawyers cosseted in leathered briefs discuss the depth of the anti-Mexican deluge, the boots on the ground of this immigrant monsoon wear badges and guns.

If police officers were supermen, there would still be the matter of kryptonite; lawmen, however, like the rest of us, are human: The alarm doesn't go off, but the spouse does; calls get dropped, coffee gets spilled. And, every so often, officers' problems are the stuff of television drama.

Now, like Noah with his ark, the police will sort the brown in the automobile: "You two remain; you two go to Nogales."

Daniel Magos, once an immigrant, now a United States citizen, is one man who understands the divide in a cop's life.

Once, when one of Sheriff Joe Arpaio's men had a flat tire, Daniel stopped to help.

On another occasion, a deputy was adrift in a conversation with a Spanish-speaking immigrant in south Phoenix. The officer had trouble understanding or being understood. Daniel stepped forward and translated for Arpaio's man.

Nor has Magos hesitated in the face of danger.

In 2000, he saw a group of men attacking what he believed was a mojado, a wetback. Magos summoned a deputy. The lawman grabbed one of the belligerents, and as his compadres attempted to flee in a car, they tried to run over the deputy. The officer gave his prisoner to Daniel.

"You hold him for me," Magos recalled the deputy telling him.

The deputy then gave chase in his vehicle, and the pursuit ended only when those fleeing crashed their car. In the ensuing chaos, Daniel was left to his own devices. "I called the sheriff's department and asked: 'What will I do?'"

What Daniel Magos would do today, 10 years later, is walk away.

What changed?

Only this: Daniel and his wife, Eva, were recent victims of racial profiling.

Daniel and Eva were, if you will, ahead of their time, ahead of SB 1070. And herein lies a small story about what happens when we hunt Mexicans and Mexican Americans and Central Americans in our national hysteria over the brown-skinned people amongst us.

We hear so often that Senate Bill 1070, which demands that police — in the course of their enforcement responsibilities — question people about their citizenship, will frighten Latinos away from speaking up in domestic-abuse calls or in drug investigations or in gang probes.

Critics of SB 1070 characterize the victims of this racial-profiling bill as a population caught up in some low-rent episode of Law & Order.

The caution that SB 1070 will make witnesses silent is true, as far as it goes.

But SB 1070 has a more insidious side.

The victims of racial profiling sacrificed to the nativist fears that spawned SB 1070 are just as likely to be upstanding American citizens, even Good Samaritans like Daniel Magos .

Keep this in mind as America rushes to inquire: Are your papers in order?


Born in 1945, Daniel Magos is soft-spoken, reserved, firm. Despite the run-in with a sheriff's deputy he and his wife suffered, his manner is dignified, not put-upon. He presents the sort of serenity you see upon the faces of victims portrayed on holy cards. Not to suggest Daniel is a saint — he's simply a good man and a better neighbor.

He met Eva in 1965, as a 20-year-old, at the American Legion, Post 41, in Phoenix. "I was sitting at a table by myself when she and another lady came over and asked if they could sit down. It was her friend's idea."

When he met Eva's family, he had one vivid impression: "Her father was quite strict . . . If you went out to dinner, you had to be back by 8 p.m."

Dances offered a little more leeway on time, so Eva and Daniel would visit the Calderon Ballroom on 16th Street and Buckeye Road. "Actually we went next door, to Nano's. The music and the people were different. There was a higher social status at Nano's."

I have a hobby. Every Wednesday I drive around to the locations in my neighborhood that have New Times stands and I openly take the entire stack of freshly printed papers and pile them in my car. After a couple hours I usually gather about 500 papers or so (total guess on my part, I have never bothered to count). I then take them to the first dumpster I find and throw them in. I call it my personal BOYCOTT. I know it isn't much, but I take heart in the knowledge that I am doing my part to take down the mindless PC-propaganda machine that is called the New Times. If you are like me, and you are sick to death of the hateful extremist bullshit that is constantly streaming out of this paper I encourage you to do the same thing. Every time you see a New Times stand take all the papers in the stand and throw them away. Together we can force the editors of the New Times to go back to the good old "Entertainment" reporting they used to engage in. Otherwise we will simply bury them. Either way works for me.

It is obvious the writer is using redneck as a derogatory slang term for poor white citizens or anyone who agrees with them. He tosses it around like a safe racist slur. His statement suggests that these people people are inherently stupid and ignorant. The question one would have to ask is why does the writer think these people share stupidity (which cannot be corrected) as an inherent trait? His use or redneck suggests only two common factors, economic class and race. I doubt he is saying all poor people are stupid and ignorant. If so that would include poor minorities, including many (both legal and illegal) immigrants. The only other factor left is race. Perhaps the writer should preface his commentary by saying he thinks it is ok to be a racist, as long as you agree with him.

But sir let me assure you there are a lot of people from many races that are at odds. Starting back to the first time people from other countries had to register as soon as they got off the boat. I just finished reading “Get Out” (Michael Lacey, July 29). Great caricature of the intellectually challenged Jan “Governor-by-accident” Jan Brewer, by the way. Anyway, I couldn’t agree with the author more. His message that the rednecks in Arizona should just go fuck themselves was made most elegantly. So much bullshit is coming from the right that I’m choking on it. Despite what these racist ignoramuses say, we need sane immigration reform, not this enforcement-only approach that the federal government has half-ass taken. Guys, it ain’t fucking working! There has to be amnesty for hard-working, smart, contributing-to-the-system Mexican immigrants. The DREAM act, allowing the brightest and most patriotic Latino youth to become citizens, must be realized. What is it anyway with the right-wing retards that they won’t even let young people who are willing to get shot at in Iraq, young people who can become doctors and engineers, to stay in this country. Majority Leader Harry Reid and Speaker Nancy Pelosi are facing a dilemma: Although they publicly bemoan the fact that Republicans won’t help them pass an unpopular amnesty . . . er, comprehensive immigration-reform bill, they don’t want to force vulnerable Democrats to vote on amnesty this close to the November elections — especially not with unemployment at 9.5 percent.

Sen. Chuck Grassley (R-Iowa) may have uncovered the answer to their dilemma last week: an internal U.S. Citizenship and Immigration Services memo that outlines steps the Obama administration can take “in the absence of Comprehensive Immigration Reform” — that is, lawfully enacted amnesty — to “reduce the threat of removal for certain individuals present in the United States without authorization.”

The four authors of the memo, titled “Administrative Alternatives to Comprehensive Immigration Reform,” are political appointees USCIS chief of policy and strategy Denise Vanison (a former immigration attorney and partner at Patton Boggs) and USCIS chief counsel Roxana Bacon (former general counsel for the American Immigration Lawyers Association), and two career employees of USCIS director Alejandro Mayorkas, another Obama appointee.

The U.S. Constitution gives Congress — and only Congress — the authority to decide federal immigration law, but the Obama administration has come up with an extensive list of ways to ensure that a majority of the illegal aliens in the United States are allowed to remain here.

Here are just three examples of the outrageous proposals in the memo:

•USCIS could grant “parole-in-place,” which comes with a work permit and the ability to obtain a green card, to certain classes of aliens who entered the country illegally. Such classes would include those who entered as minors and those who “have lived for many years in the U.S.” A nice reward for those who have successfully violated the law for the longest period of time.•For those who overstay their visas, the memo recommends granting “deferred action,” which means that deportation is deferred indefinitely and the illegal alien can apply for a work permit. The memo suggests two particular categories of illegal aliens for deferred action: those who might benefit if Congress were to pass the DREAM Act amnesty (of which there are 2.1 million, according to the Migration Policy Institute) and those “who have resided in the U.S. since 1996 (or as of a different date designed to move forward the Registry provision now limited to entries before January 1, 1972).” The “Registry provision” referred to is an actual federal law, not that it matters to the memo’s authors.•To make sure no illegal alien is left behind, the memo suggests that DHS could simply stop issuing “Notices to Appear” (the document that starts the removal process for illegal aliens) unless the alien has a “significant negative immigration or criminal history.” Apparently, violating immigration law once or twice is acceptable. These folks wouldn’t be able to apply for a work permit, but since the Obama administration isn’t conducting worksite enforcement against illegal aliens much anymore, that shouldn’t matter.No wonder Reid, Pelosi, and Obama seem content to avoid a legislative battle over immigration; the Department of Homeland Security is hard at work on ways to implement its own amnesty.

Dear Michael, I currently just read your article in phx Newtimes and I have to disagree with your assessment of sb1070 and of our past immigrants. In the early 1800's and again a hundred years later; the immigrants who came then, came to become Americans and become part of the American culture. They left families behind in search of work and freedom, then when able paid for their families to follow; to become American citizens. No matter where they came from their first priority was to learn english and learn American customs and ways. They did this so they could get work and fit in and to become citizens of America. Sure you can dig anything up from the past or present and color it the way you want. SB 1070 is against ANY illegal in Arizona not just Mexicans as you depicted, but as it happens the majority here illegally are from Mexico and other central and south American countries or as you refer to them as brown peoples. I am against illegal immigration but not against legal immigration. Did you even try to find legal (mexican heritage) immigrants who agree with SB1070, or do you think all Mexicans are against the bill?? Your words are hollow and below the belt. Sure there are bad cops out their, they are in every state. But I believe the majority of law enforcement in Arizona do follow the laws to a "T." And furthermore, I find nothing wrong with someone who's not a citizen to carry proof that they can be here, if a situation arrises where they need to prove that they are here legally. Furthermore, I resent being labeled a hillbilly/cracker. I follow the law and whenever pulled over have to show ID as well, yes I'm white but I still have to show my ID, so why not make a state card that proves they are here legally, could be a mark on a license or an extra card they carry. SB 1070 is a way to stop illegal immigration from happening; you ever read Mexicos illegal immigration laws? Why then can we not do the same. There are over 40million illegals in the USA. That's a lot of jobs that I know any American would work with the economy being so bed. In closing, I find that your article was wrong and way out of context. So, try moving to Mexico. Go ahead sneak across the border (if the cartels don't get to you first or the federales) and try and find a job there. It won't happen because they will put you in jail or you will be sent back or even killed. Remember its a federal crime to be here illegally. Yet the government won't do anything to stop it, why, because they need the votes to push their anti-capitalism/America agenda through. I praise Jan Brewer for having the gall to defend her state and the citizens within its borders.

Perhaps you haven't heard the example of the guy who leaves for work in the morning only to come home and fine his house broken into. The inside of the house has been cleaned and painted, the broken disposal fixed, the lawn mowed and dinner is waiting on the table. he finds who broke into his house and says I'm calling the police. The intruder says but look at all the nice things I did for you. Bottom line: He broke into the guys house. Yes, something has to be done to try and let the "illegals" make amends, a fine perhaps, paying back taxes, paying current taxes etc. Which the majority won't do. And because our country is based on laws and government, yes it is the politicians and not the magazine writers who will fix the problem. As soon as the rule of law can be put aside with "sorry, I don't understand" (which is why by the way that ignorance of the law is not a defense in this country) you won't even be able to write your column. Have the guts to respond?

I have recently been working on my family tree and found 100% of my family migrated here from Switzerland, Germany and England. My husbands family from Mexico. Just in my family as many Americans need to reflect on is. " Who was here first?" It certainly wasn't my family.. Native Americans and Mexican people were already here. It was white people who forced Africans here as slaves, booted the Native Americans off their land and drove Mexicans to small parts of land. Truly this article is about the injustice surrounding illegal persons. I find it interesting that the author believes that it is my repsonsibility to support people from another country with free medical, free housing, free education, etc., and making them follow our laws to become citizens. The state of Arizona did a srudy 4 - 5 years ago and identified that 46 cents out of every tax dollar is used to support illegal aliens. Why can't we treat them just like they would treat us in Mexico, or China, or the Phillipines, or India, or Korea or any of the other nations represented here. Nowehere does it state that we have to support the world and if you know it, we can not. This country has a real financial crisis that is being smoothed over. Please realize that I firmly believe in diversity, legal diversity as we all have agreed to in our legislation. It is a real insult to legal citizens to try to slide these people in. They can follw the same path as other legal citizens have followed and all of us together can build a better United States. Speaking Spainish or Chinese and ignoring English precludes learning and growing. No other language allow for personal expression is as few of words allowing us to communicate at a higher level. This is our society, our country, and our land. If they just want to pillage and rape the good stuff off the top, it hurts all citiznes. It is time to respect the people who have spent the time to become legal citizens and stop people like this author! Besides trying to fuel the fire, obviscation is the primary goal, fear and misrepresentation are right behind. Lets celebrate America by honoring citizens and realize that we have to repair a situation where Obama is just trying to buy votes by sliding these people in. I whole heartedly agree with this article. I have lived in Phoenix for the past 5 years, lived here my whole life and I am a U.S. citizen, but I am East Indian, commonly mistakened for Latino by hillbillies in Arizona, and the racism and traffic stops and physical violence I have suffered at the hand of law enforcement here has been unimaginable. And for what, for existing. None of the incidents was I doing anything wrong or illegal, not once was I issued a citation. Just big kids abusing their badges. It's amusing to me to see on television how white folk say that racism doesn't exist in America anymore. I think you forgot to send the memo to all your hillbilly brethren. Ignorance of evil is no exucse for passivity, ask all the survivors of WWII and how ignorance on America's part lead to Pearl Harbor and finally the U.S. took action! I forgot, ethnic studies is illegal here to so you probably missed that chapter in high school too! As someone who lived abroad in the U.K. and fulfilled all requirements to live and work there, I whole heartidly agree with taking the necessary steps to become a citizen or getting some sort of work visa. It was time consuming and expensive and the right thing to do. The process required that we leave the country if ever we were unable to provide for ourselves, of course recieving or taking benefits from a country you are not a citizen of really does seem inherently wrong, but...and I understand the names I will be called for this, or how unpopular it is to have empathy or compassion these days ( so not cool here anymore eh?)...I know I will be labled a bleeding heart liberal, etc...( which I'm not, I have other views that conflict with that theory)...You came from New Zealand, not exactly as drug war ravaged, not so much corruption, not without the oppurtunity to do something with your life because of the drug wars and corruption right?The majority of the people who illegally enter our country risk their lives and loss of loved ones to escape the corruption and unending poverty they were born into...they want a small piece of what we have, freedom, employment, a house ....they want this more so for their children...I don't believe the way they go about it is right , I don't believe they should expect concessions such as spanish speaking options for everything anymore ( you want to live in or work in another country, maintain your own language at home,but respect the language and culture you want to live in, I did)..I don't believe they should come here and recieve government aid from a country whose government is not theirs..etc..But please understand these are human beings who want a better life...Of course there are criminals within the illegal immigrant population, there are criminals of every nationality color and culture, We rather focus on their crimes lately...I just ask for practical and positive solutions based on the real issues here, Everything that has been done has not worked, and nothing being suggested will not in the long run either, people rarely fail to want to thrive .P.S., Did you marry for the sole purpose of the green card because you rather make it sound like you earned it by doing your time there.
